Conor Friedersdorf: “Why Dr. Kermit Gosnell’s Trial Should Be a Front-Page Story”

In The Atlantic, Conor Friedersdorf explains why the Philadelphia horror story should be front-page news, but isn’t:

The grand jury report in the case of Dr. Kermit Gosnell, 72, is among the most horrifying I’ve read. “This case is about a doctor who killed babies and endangered women. What we mean is that he regularly and illegally delivered live, viable babies in the third trimester of pregnancy — and then murdered these newborns by severing their spinal cords with scissors,” it states. “The medical practice by which he carried out this business was a filthy fraud in which he overdosed his patients with dangerous drugs, spread venereal disease among them with infected instruments, perforated their wombs and bowels — and, on at least two occasions, caused their deaths.”

Charged with seven counts of first-degree murder, Dr. Gosnell is now standing trial in a Philadelphia courtroom. An NBC affiliate’s coverage includes testimony as grisly as you’d expect. “An unlicensed medical school graduate delivered graphic testimony about the chaos at a Philadelphia clinic where he helped perform late-term abortions,” the channel reports. “Stephen Massof described how he snipped the spinal cords of babies, calling it, ‘literally a beheading. It is separating the brain from the body.’ He testified that at times, when women were given medicine to speed up their deliveries, ‘it would rain fetuses. Fetuses and blood all over the place.'”

One former employee described hearing a baby screaming after it was delivered during an abortion procedure. “I can’t describe it. It sounded like a little alien,” she testified. Said the Philadelphia Inquirer in its coverage, “Prosecutors have cited the dozens of jars of severed baby feet as an example of Gosnell’s idiosyncratic and illegal practice of providing abortions for cash to poor women pregnant longer than the 24-week cutoff for legal abortions in Pennsylvania.”

“Elite Panic” and the media gatekeepers

There’s a pretty horrific tale unfolding in a Philadelphia court room, but most people won’t have heard about it because — while it’s bloody and otherwise eminently newsworthy — it will “send the wrong message” if it gets the traditional full-court press of media attention. At Ace of Spades H.Q., this is noted and explained by Ace:

I think this is how those who imagine themselves to be elite justify their complete embargo on the Kermit Gosnell serial-murder trial.

People who do evil generally don’t imagine they’re doing evil. In fact, some of the worst evils are perpetrated by those who’ve convinced themselves they’re doing good. One’s conscience tends to restrain one from evil; but if one can trick one’s conscience into thinking one’s doing good by doing evil, well. Then you’ve really got something.

I imagine the media believes it’s “doing good” by being so cautious about What Truths the Public Is Capable of Hearing. After all, if this Gosnell trial were publicized, people would Get Angry, and come to All the Wrong Conclusions, and put the allies of those in the media (such as NARAL and Planned Parenthood) on the defensive.

Hell, these maniacs might even get in into their skulls to hurt people!

Well, we can’t have that. We can’t let the Wrong Kind of Information — true information, but the sort of information the non-enlightened may be confused about — passing into the Wrong Kinds of Brains.

Thus, this embargo on the Gosnell story is not just partisan bias, fronting for the Democrats by refusing to mention anything that might be used as a wedge issue against them.

No, this embargo is done for the Public Good, even if the public is too stupid to understand that. If the public heard about these things … Well, that’s not gonna happen. Not on our watch.

It’s been occurring to me lately that much media behavior is explainable by this prism. They don’t want to report certain facts, not because the facts aren’t true (they’re facts by definition), but because they’re Concerned About The Capacity of Non-Journalists to Successfully Interpret These Facts.

The former players’ class-action suit against the NFL

John Holler opines that the players are morally right, but that the legal system probably won’t give them the vindication they hope for:

Inaccurately known as the City of Brotherly Love – a more appropriate definition would be the City of Unholy Beat-Downs In the 600 Level – Philadelphia was the site Tuesday of the first big meeting on men in $5,000 suits and matching ties and pocket splash.

Judge Anita Brody heard arguments Tuesday from the NFL and a class-action group of more than 4,000 NFL players concerning the NFL’s culpability for not diagnosing concussions in the formative years of the NFL becoming the financial juggernaut it is today.

It’s a complicated and sometimes emotional battle. From a personal perspective, I teared up (that’s a generous description of it) after interviewing Brent Boyd at a time when he was a lone candle in the wind seeking justice for his injuries at a time when the NFL denied any connection to playing the game and post-concussion symptoms. Boyd was in an a cappella group at that time. Now he has a loud chorus of backup singers in the choir. Boyd was right when he told Congress that the NFL’s policy toward worker’s compensation claims were characterized – in his words – as, “Delay, deny and hope they die.”

On the other side of the coin is the legal question. It’s not a coincidence that Lady Justice, the sculpture of a woman holding the scales of justice, is blindfolded. The intent of that symbolism is that a jury can only render a verdict on the facts presented. A former NFL player from the 1970s once posed the question to me, “Does Boeing owe former employees more benefits now because the company became successful?” That was a hard pill to swallow considering that, even in the 1970s and 1980s, there were enough former players suffering from dementia and game-related debilitation that an impartial juror could see the connection between playing NFL football and the results that have followed in post-football life for thousands of former players. Yet, what does the current NFL owe them?

Parenting classes are a waste of time and money

Elizabeth and I took parenting classes, as neither of us had much experience of dealing with infants or small children before our son was born. Although the instructor was good at being re-assuring that we’d do fine as parents, almost none of the “skills” we were taught were actually of much use after the baby arrived. Since those early-90’s days, parenting courses have become even more common, but as Frank Furedi points out, no more relevant to the actual needs of parents and their newborns:

The parenting programmes promoted by government are based on a mixture of prejudice and the pseudoscience of so-called parenting research. Such ‘research’ is underpinned by a fundamental transformation in the meaning of parenting, which has been turned from a relationship into a skill. The core assumption in the government’s proposal for parenting classes is that childrearing consists of a set of practices that need to be learned by mothers and fathers. These practices are depicted as skills which can be taught by those who have the requisite professional qualifications.

No one could dispute that childrearing is something that is learned by mothers and fathers. Every human relationship involves a continual process of learning and gaining an understanding of the other person. Parents need to learn how to engage with the imagination of their child, how to stimulate her and when and how to restrain her from doing something harmful. Successful parents learn on the job. However, the really useful lessons we are learning have little to do with abstract skills, but rather are about understanding the relationship we have with our children.

The question is not whether parenting has to be learned, but whether it can be taught. Not everything that has to be learned can be taught. Parenting cannot be taught because it is about the forging and managing of an intimate relationship. And it is through the conduct of that relationship that people develop the insights and lessons suitable to their lives and conditions. One reason why professional intervention into family life is unlikely to have beneficial results is because each relationship contains something unique, which is only grasped by those involved in it.

However, the project of transforming parenting into a skill does have negative and potentially harmful consequences. When human relationships are recast as skills to be managed by professional trainers something very important happens in the way we conduct our personal affairs. As I argue in my study Paranoid Parenting such policy interventions cultivate a kind of learned helplessness among parents. Through exaggerating the complexity of child-rearing, parenting experts contribute to the eroding self-reliance of modern mums and dads. Inevitably, the principal outcome of such interventions is to distract parents from learning from their own experience. And yet learning from experience is the key to developing the confidence for making those crucial judgment calls that confronts parents on a daily basis.

Demonizing smokers hasn’t forced them to quit … let’s start sending them to psychiatric care instead

When the all the persuasion, “nudging”, shaming, harassment, and legal shenanigans haven’t worked, try taking a leaf out of the old Soviet Union playbook for dealing with dissidents:

Smoking may be a sign of psychiatric illness, experts say. Doctors should routinely consider referring people who smoke to mental health services, in case they need treatment, they add.

The controversial recommendation from the British Lung Foundation, a charity, comes in response to a major report, Smoking and Mental Health, published this week by the Royal College of Physicians and the Royal College of Psychiatrists with the Faculty of Public Health. It says that almost one in three cigarettes smoked in Britain today is smoked by someone with a mental disorder. When people with drug and alcohol problems are included the proportion is even higher.

The reason is that smoking rates have more than halved over the past 50 years, but the decline has not happened equally in all parts of society.

“Smoking is increasingly becoming the domain of the most disadvantaged: the poor, homeless, imprisoned and those with mental disorder. This is a damning indictment of UK public health policy and clinical service provision,” the report says.

Take diet change recommendations with a pinch of salt

Yes, yes, I know salt is one of the most dangerous substances known to man. Well, this week, anyway. Next week they may decide to recommend doubling your daily intake instead of reducing it. It’s an example of the nanny state’s long history of providing inconsistent — and sometimes even dangerous — dietary advice:

The government told people to switch from saturated animal fats to unsaturated vegetable fats. But that advice may have killed a lot of people. As David Oliver notes, a recent study “in the British Medical Journal” shows that ”those who heeded the advice” from public-health officials “to switch from saturated fats to polyunsaturated vegetable oils dramatically reduced their odds of living to see 2013,” incurring up to a ”60% increase in risk of death by switching from animal fats to vegetable oils.” This possibly deadly medical advice has a long history:

    Fifty years ago the medical community did an about-face … and instead went all in on polyunsaturated fats. It reasoned that since (a) cholesterol is associated with cardiovascular disease and (b) polyunsaturated fats reduce serum cholesterol levels, it inescapably followed that (c) changing people’s diet from saturated fats to polyunsaturated fats would save a lot of lives. In 1984 Uncle Sam got involved – Time magazine reported on it in “Hold the Eggs and Butter” – and he made a big push for citizens to swap out animal fat in their diet for the vegetable variety and a great experiment on the American people was begun.

As Oliver, an expert on mass torts, points out, it is hard to ”think of any mass tort, or combination of mass torts, that has produced as much harm as the advice to change to a plant oil-based diet” may have done.

Some federal food-safety regulations have also harmed public health, such as the “poke and sniff” inspection method “that likely resulted in USDA inspectors transmitting filth from diseased meat to fresh meat on a daily basis.” The Obama administration has foolishly discouraged potato consumption, even though potatoes are highly nutritious, even as it has subsidized certain sugary and fatty foods, and promoted bad advice about salt.

Humans are very good at spotting patterns … even when they aren’t really there

In Slate, George Johnson explains why the human ability to detect patterns can sometimes work against us:

Lay a chessboard on a table. Then grab a handful of rice and let the grains fall and scatter where they may. They won’t spread out uniformly with the same number occupying each square. Instead there will be clusters. Now suppose that the chessboard is a map of the United States and the grains are cases of cancer.

Each year about 1.6 million cases of cancer are diagnosed in the United States, and epidemiologists regularly hear from people worried that their town has been plagued with an unusually large visitation. Time after time, the clusters have turned out to be statistical illusions — artifacts of chance.

The Erin Brockovich incident, one of the most famous, is among the many that have been debunked. Hexavalent chromium in the water supply of a small California town was blamed for causing cancer, resulting in a $333 million legal settlement and a movie starring Julia Roberts. But an epidemiological study ultimately showed that the cancer rate was no greater than that of the general population. The rate was actually slightly less.

The scare stories about increasing antibiotic resistance

In sp!ked, Robin Walsh debunks some of the scare factor from recent reports about antibiotic resistant diseases and the looming pandemic:

The UK’s chief medical officer (CMO), Professor Dame Sally Davies, made a splash in the media this week with her warning that antibiotic resistance is the new climate change. There is a ‘catastrophic threat’ of ‘untreatable’ diseases, she said, which promise to return us to a ‘nineteenth century’ state of affairs. The CMO has form: she warned the House of Commons health select committee about the same problem in similarly stringent terms back in January — a case not so much of apocalypse now, as apocalypse again.

As with all such stories, reading the actual CMO’s report leavens some of the hysterical excesses of the press, which were stoked up by the CMO’s excitable media appearances. Setting out the epidemiology of infectious diseases in the UK, the report highlights that while some drug-resistant infections, such as the well-known Clostridium difficile (C diff) and MRSA, are becoming less widespread, there is an increasing occurence of harder to treat multi-drug resistant bacterial infections, which, although still only in the hundreds of cases per year, are on the rise. The report states that only five antibiotics to fight such infections are currently in phase II or III trials, so the cupboard seems worryingly bare of new, necessary drugs.

So if we’re running short on drugs, how can we make more? A sensible article in the British Medical Journal from 2010 clearly set out the challenges facing the development of new antibiotics. Firstly, there are many regulatory hurdles that make running clinical trials in this area difficult. More importantly, there is a major financial disincentive for drug companies to develop antibiotics. Currently, drugs which are profitable are those for chronic conditions that are prescribed lifelong: painkillers for arthritis, diabetes drugs, and the like. A drug that you take once to cure you is unprofitable; doubly so if it is likely to be husbanded to prevent resistance developing until the patent runs out. A change in government payments to incentivise new antibiotics, like that which already applies to so-called ‘orphan’ drugs for rare diseases, would be an easy and rational step towards producing more drugs that meet our needs.

Food safety “churnalists” strike again: processed meat will kill you!

In sp!ked, Rob Lyons explains why the most recent food flap in Britain is no more worth paying attention to than the last couple of dozen:

‘Processed meat blamed for one in 30 early deaths’, declares the Daily Telegraph. ‘Processed meat “is to blame for one in 30 deaths”: scientists say a rasher of cheap bacon a day is harmful’, says the Daily Mail in the true spirit of ‘churnalism’, while the addition of ‘cheap’ to the headline is surely designed to confirm the prejudices of its snobbier readers.

The BBC, which has made a veritable full English breakfast of this story this morning, summed it up as follows: ‘Sausages, ham, bacon and other processed meats appear to increase the risk of dying young, a study of half-a-million people across Europe suggests. It concluded diets high in processed meats were linked to cardiovascular disease, cancer and early deaths.’

However, the reality is that the methods used in such studies are so crude that drawing sweeping conclusions from this evidence is fraught with difficulties.

As so many times before, the actual link between the reported data and the eye-catching headlines is not particularly strong or likely to be a cause of worry for most people.

There is a lot of guesstimating going on here. Even after all this, the size of the effect is small. Previous claims about processed meat have focused on cancer, but here the increased risk of cancer was just 11 per cent. The bigger, all-cause mortality figure of 44 per cent was mostly due to cardiovascular disease, a risk which even the researchers suggest may be overstated.

Claiming that such a small effect can therefore be the basis of sound dietary advice is just nonsense — but it is nonsense that is repeated all too frequently. The result is to create unnecessary fear about perfectly good food and confirm the prejudices of those who think that processed food is only fit for the masses.

Opening the food testing can of worms: “We don’t test for hedgehog either”

Tim Worstall on some of the issues with demands that all British beef for human consumption be tested for horsemeat:

Now let’s turn to that meat problem. We’re going to test something to make sure that it is indeed what it says. Most of the time, usually, we’d go looking for beef DNA and on finding it say, yup, that’s beef.

But now we’re talking about trace amounts of other species. Some of this horse contamination is someone deliberately substituting, yes. But a lot of it, those trace amounts, is someone not cleaning the pipes between species being processed. Or the knives even. Which leads us to something of a problem.

How many species do we test for? Some minced beef… or pink slime perhaps. Do we test for beef and horse? For beef, horse, mutton, pork, chicken, duck, goose? What about rat and mouse? For I’ll guarantee you that however much people try there will often be the odd molecule of either one of those in there. Sparrow? That’s more of a problem with grain processing but still.

For example, one lovely story about vegetarianism. Those (umm, OK, some) who have moved from the sub-continent to the UK. They carry on eating the (possibly Hindu caste based) vegetarian diet they are used to. And they start falling prey to all sorts of dietary deficiencies. Anaemia, there have even been reports of kwashikor (a protein deficiency). The grains and the pulses of the sub-continent have rather more insect and other residue in them than our more modern processing and storage systems provide.

People don’t test for hedgehog DNA in meat supplies, no. But how many species should they test for?

Whinnygate is just a useful distraction from the real scandal in the NHS

The British media is doing a great job of distracting the public with the horsemeat story, and the politicians and National Health Service bureaucrats are delighted that nobody is paying attention to the real scandal:

At any given moment, there exists at least one delicate subject that all mainstream political parties would much rather not discuss. For many years the abuse of MPs’ expenses fell into this category. After this was exposed by a Telegraph investigation, everyone joined a tacit agreement to keep quiet about the criminality inside the Murdoch newspaper empire.

Now the subject which nobody wants to talk about is the National Health Service. It is just over a week since the publication of the Francis report into Stafford hospital, where some 1,200 patients died in appalling circumstances. Had any other institution been involved in a scandal on this scale, the consequences would have been momentous: sackings, arrests and prosecutions. Had it involved a private hospital, that hospital would have been closed down already, and those in charge publicly shamed and facing jail.

Astonishing to relate, nothing has happened. Politicians have made perfunctory expressions of concern, while agreeing that there must be “no scapegoats”, and that Sir David Nicholson (the senior figure responsible) must remain in his job.

Then, almost at once, the political class turned its attention to a far more lively subject: horse meat. Few “scandals” in living memory have carried less significance. And yet few stories have dominated the press quite as comprehensively since rival teams of crack reporters from The Sun and The Star pursued Blackie the Donkey across Southern Spain in 1987, in the wake of some dubious allegations of mistreatment by his Spanish owners.

Misdirection is a vital tool in the arsenal of the magician — and it can be even more valuable in the political arena. If they can fool you into watching the hand that isn’t hiding the coin, they can get away with a great trick (magicians) … or a great evil (politicians).

A useful bit of perspective over Whinnygate

It’s reasonable to be concerned that your hamburger may once have raced in the Grand National, but worries about chemical contamination from the horse meat are almost certainly overblown. In fact, your health might be more at risk from the burger itself:

There is reasonable public outrage at possible criminal conspiracies to adulterate meat products with horsemeat, and additional concerns raised about the presence of the anti-inflammatory known as bute.

While not in any way questioning this concern about adulteration with a chemical compound, it is helpful to get a sense of magnitude. When bute was given as a human medicine, it was reported to be associated with a serious adverse reaction in 1 in 30,000 (over a whole course of treatment), but at a dose giving concentrations at least 4,000 times that arising from eating a diet of horse meat – see the excellent information from the Science Media Centre

So making all sorts of heroic assumptions about there being a linear-no-threshold response, we might very roughly assign a pro-rata risk of a serious event as 1 in 100,000,000 per burger.

Debunking the “1970s had a higher standard of living than today” meme

Don Boudreaux produces an anecdotal list of things that refute the inane notion that America’s standard of living peaked in the 1970s:

What follows here is drawn from memory. Perhaps my memory is grossly distorted, but my report of it here is an undistorted reflection of that memory. Here’s some of what I recall, of relevance to this discussion, from middle-class America of the 1970s; I offer the 25 items on this list in no particular order, except as they come to me.

(1) Automobiles broke down much more frequently than they break down today, hence, leaving motorists stranded, sometimes for hours, more often than is the case today.

(2) Automobiles rusted faster and more thoroughly than they do today.

(3) Someone in his or her early 70s was widely regarded as being quite old.

(4) “Old” people back then were much more likely to wear dentures than are “old” people today.

(5) Frozen foods in supermarkets were gawdawful by the standards of today – in terms both of quality and of selection.

(21) Coffee sucked. (It was almost all made from robusta beans.) And the selection of teas was pretty much limited to whatever Lipton sold.

(22) A diagnosis of cancer was far more frightening than it is today. Any person so diagnosed was regarded as being as good as dead.

(23) Going to college was much more unusual than it is today.

(24) Contact lenses were much more expensive than they are today. I purchased insurance (!) on my first pair of soft contact lenses (which I bought in 1980) in order to protect myself against the financial consequences of losing or damaging the one pair that I bought. (Such lenses were bought one pair at a time.)

(25) The idea of widespread use of personal computers seemed like science fiction. I very clearly recall overhearing, in the Spring of 1980, one of my economics professors, Wayne Shell (who also taught computer science), telling someone that he believed that, within a few years, many American households will have a computer. I thought at the time that Dr. Shell’s prediction was fancifully far-fetched.

I could go on, listing at least another 50 such recollections. But instead I’ll end this post here.

The domestic food desert

Theodore Dalrymple on one of the more likely culprits for obesity among poor British families:

With the decline of the family — wrought by the policies of successive governments — patterns of eating have changed. Meals in many households, especially those of the relatively poor, are no longer family or social occasions. It has been found that a fifth of children do not eat more than one meal a week with another member of their household; and in such households, which I used sometimes to visit as a doctor, the microwave oven was the entire batterie de cuisine, or at any rate the only cooking implement that was ever actually employed.

Moreover, there was no table at which a meal could have been eaten in common if anyone had thought of doing so. The result was that children became foragers or hunter-gatherers in their own homes, going to the fridge whenever they felt like it and grazing on prepared foods — high, of course, in the evil fructose. Not coincidentally, these households were also the least likely to have what would once have been considered the normal family structure.

Such households also tended to be in areas called “food deserts”, in which fresh produce is either not easily available or unavailable. But those who ascribe the dietary habits of the households I have just described to food desertification put the cart before the horse: for if heroin can reach these areas (and it can), surely the humble lettuce can do so?

It is also sometimes alleged that people buy prepared foods because they are cheap. This is nonsense. In fact, if you go to areas inhabited by poor Indian or Pakistani families you will find stores that sell an astonishing range of vegetables at equally astonishing prices. I used to shop in one such store, at a time when I did not have to concern myself too much over the price of food; I could hardly carry all that I could buy for a few pounds. I remember in particular a 10-kilo bag of onions costing £1.49.

The Indian and Pakistani women bought with discrimination and, taking a maternal interest in me, would sometimes indicate what to look for among what were for me the more exotic vegetables. But I never saw any poor whites shopping there: they went straight to the pie and pizza shops, without so much as a glance at the okra and aubergine.

In other words, food desertification and the supposed cheapness of industrially prepared foods is a consequence, not a cause of, the food habits I have described. Food desertification is a symptom of the culinary ignorance, incompetence and indifference of a substantial minority of our population: ignorance, incompetence and indifference unopposed by any attempt of our educational system to counteract it, for example by teaching girls the elements of cookery. Fat is indeed a feminist issue, but not in the sense that Susie Orbach originally meant it.

QotD: When God sticks his nose into public health and taxation issues

It is not an original thought to say that public health crusaders often resemble religious zealots, but seldom is the comparison more literal than in the case of Mike Rayner, director of the British Heart Foundation Health Promotion Research Group.

So far, so mundane. Another illiberal battler against the free market with a heightened sense of his own importance and his nose in the trough. The only point of interest is that Mr Raynor is a Church of England priest who is guided by voices.

    In all of this I see a sacred dimension. You may not believe that I have heard God aright but I think God is calling me to work towards the introduction of soft-drink taxes in this country and I am looking forward to the day when General Synod debates the ethical issues surrounding this type of tax rather than some of the other issues that august body seems obsessed by.

Golly. Where to begin? On a theological note, I do wonder whether Jesus would really be in favour of a deeply regressive stealth tax that would take from the poor to give to the rich. Perhaps the reason the General Synod does not debate tax policy is because they recall the old “render under to Caesar…” message and realise that it’s none of their business.

If we weren’t already sceptical about the documents coming from Mr Rayner’s team of would-be policy-makers, the fact that its director believes that God has told him to bring about a fat tax in this land should be enough to make us suspect that a tiny bit of research bias might have crept into his work. Considering that the Almighty has approved of the policy, what are the chances of his loyal servant producing evidence that would question its efficacy?
