There is a moment at the end of Art of the Trio 4, a live album released last year by 28-year-old pianist Brad Mehldau, when the problem with contemporary jazz is crystallized. After a seemingly endless set displaying his pyrotechnic virtuosity, Mehldau slides into Radiohead’s “Exit Music (For a Film).” He plays the song straight, his suddenly spartan piano style capturing the rich, chilling vocal melody. There’s no endless jamming, no fearful retreat into what has become the classicism of legends like Thelonious Monk, John Coltrane, Charlie Parker, and Dizzy Gillespie — just a simple embrace of a brilliant pop song, like Sinatra doing Mercer or Ella singing Ellington.
It was a rare moment of clarity in jazz, and as such revealed a certain hollowness to the rest of the album. Jazz has become sadly irrelevant. A recent issue of Down Beat reported that jazz sales last year accounted for only 1.9 percent of record purchases, down from even a few years ago. That’s a striking figure, and points to a sad conclusion: the music, once the source of some of the most unassailable popular songs ever waxed, has become an esoteric specialty, like speaking Latin. Next year Ken Burns will unleash his ten-part magnum opus on jazz, which makes sense. Who better to eulogize something deader than the Confederacy?
But then I suppose I’m not fit to judge. I came to jazz only about five years ago, just before the erstwhile swing boom. I liked some of the new swing music, which makes me a pariah in the eyes of “real” jazz fans, many of whom hated it the way punks hate the Backstreet Boys. Legendary pianist Oscar Peterson told Down Beat that he was “quite fed up with guys putting on porkpie hats, tilting their saxes like Lester [Young, the great Kansas City player], and calling it swing even though they still sounded like rock groups. Obviously, they haven’t done their homework and wouldn’t know Lester’s sound if it rolled over them in a steam roller.” Well, sure, most of the stuff was crap — most of anything is crap — but a few genuinely great songs were recorded: “Love” by the Camaros, “Pink Elephant” by the Cherry Poppin’ Daddies, and just about everything on All Aboard! and Red Light! by San Francisco’s Indigo Swing. If nothing else, these served as a reminder that jazz was once the catchiest music in America. In listening to the massive Duke Ellington box set The Centennial Edition, I am struck by not only the instrumental virtuosity of Duke’s bands but also the sheer stickiness of the songs: “Sophisticated Lady,” “Day Dream,” “I Got It Bad (And That Ain’t Good),” “Perdido,” “In a Sentimental Mood,” “I’m Beginning to See the Light,” “Cotton Tail” — the list could go on for pages. Before jazz became fat with government grants and cozy in its mutual admiration society with academic audiences, it required hits to survive, and hits require great hooks. Unless jazz musicians learn how to write tunes again, it’s doubtful that in another hundred years we’ll be celebrating anything except the bicentennial of Ellington’s birth.

Is the end in sight for California’s high speed rail fiasco?
Virginia Postrel says the state’s high speed rail boondoggle may finally run out of chances:
California’s high-speed rail project increasingly looks like an expensive social science experiment to test just how long interest groups can keep money flowing to a doomed endeavor before elected officials finally decide to cancel it. What combination of sweet-sounding scenarios, streamlined mockups, ever-changing and mind-numbing technical detail, and audacious spin will keep the dream alive?
Sold to the public in 2008 as a visionary plan to whisk riders along at 220 miles an hour, making the trip from San Francisco to Los Angeles in a little over two and a half hours, the project promised to attract most of the necessary billions from private investors, to operate without ongoing subsidies and to charge fares low enough to make it competitive with cheap flights. With those assurances, 53.7 percent of voters said yes to a $9.95 billion bond referendum to get the project started. But the assurances were at best wishful thinking, at worst an elaborate con.
The total construction cost estimate has now more than doubled to $68 billion from the original $33 billion, despite trims in the routes planned. The first, easiest-to-build, segment of the system — the “train to nowhere” through a relatively empty stretch of the Central Valley — is running at least four years behind schedule and still hasn’t acquired all the needed land. Predicted ticket prices to travel from LA to the Bay have shot from $50 to more than $80. State funding is running short. Last month’s cap-and-trade auction for greenhouse gases, expected to provide $150 million for the train, yielded a mere $2.5 million. And no investors are lining up to fill the $43 billion construction-budget gap.
In the UK (and in the USA), the peasants are revolting
At Questions and Observations, Dale Franks writes about the distrust of the traditional “elites” among the non-elites of society:
There’s a growing sense, not only in Great Britain, but in the US as well, that the elites, or the political class, or whatever you’d like to call them, are incompetent and have been leading us astray. And the response from elites is to call those criticisms illegitimate. Those doing the carping are assumed to be racists or nationalists, both of which, of course, are unpleasant, dirty types of people. Both the UK’s Leavers and the US’s Trumpers share some commonalities. Among them are skepticism over free trade and free immigration; concerns that elites dismiss as foolish and uneducated. And, of course racist.
But perhaps the Leavers weren’t so concerned with brown people because they were brown, but because they were concerned at seeing buses being blown up in London, British soldiers being beheaded in broad daylight in the High Street, and dozens of children being raped for years in Rotherham. Perhaps, the British people have come to wonder about immigration because many immigrants seem less interested in becoming British than they are in making Britain more like the Middle East. And, maybe, just maybe, the Leavers prefer to live in Britain, in the free and modern culture that has developed over the last 1,500 years, rather than go back to live in the year 692. Maybe they wouldn’t be any more interested in living in the 13th-century culture of Richard the Lion-Hearted any more than they are in living in the Dark Age culture of Middle Eastern immigrants.
When people come into your country from elsewhere, they don’t do so simply as fungible economic units, but as real people, who bring along cultural and political ideas that may conflict those that are traditional in your country. It is almost at the point where elites cannot even conceive of an argument that implies the superiority of one culture over another, so they dismiss this argument as nationalism and nativism. But, the thing is, a free society that continually imports immigrants who have no interest in individual liberty, religious freedom, and political pluralism, will eventually have none of those things. The problem isn’t race. It’s culture.
National sovereignty means something. At the very least, it means that the people of a country have the absolute right to restrict immigration to the sort of people that will, in their judgement, benefit the country, and, once the immigrants arrive, to force them to assimilate to the country’s national culture more than the country accommodates the culture of the immigrant. No obligation exists, in any sense whatsoever, that requires the people of a country to allow entry to immigrants who desire to transform the country into something different. It is entirely legitimate to reject calls for sharia in the UK, just as it’s entirely legitimate to be upset by seeing political protestors in the US waving Mexican flags or wearing “Make America Mexico Again” hats, explicitly letting us know where their primary political allegiance lies. Nor is it illegitimate to wonder why such people are in this country, and not in the corrupt shithole of a country that they so obviously prefer, yet so oddly fled.
QotD: The USA is finally over the War of 1812
On behalf of the United States of America and the Department of Defense, I wish our partners in North American defense a very Happy Canada Day.
We have long stood on the same team, as allies, except for the War of 1812, which was 200 years ago and no one really remembers that anymore. I certainly don’t spend a lot of time thinking about how insane it would be to ever trust a Canadian, and definitely never think about how fast and easy it would be to grow the United States from 50 states to 60.
This day celebrates over 148 years of a united Canada, one of the most peaceful, democratic and stable nations on Earth. You are an example to the world, and we as Americans celebrate alongside you, not to keep an eye on what you’re doing to make sure you don’t start building a coalition to say, bombard Baltimore Harbor again, but because the lessons of the past make us stronger together. And really, we should be even closer together.
Canada Day recognizes the day in which three independent colonies united as one Canada. America, too, is a nation of independent colonies, united under a shared vision of liberty and justice for all. If one were to really think about it, it would make a lot of sense to have a larger America, from sea to shining Arctic sea, and really it probably would have happened a century ago if some of the colonies wouldn’t have started backing the British, even after they interfered with Atlantic shipping.
We could have called it, I don’t know, “Amerida” for a while, but honestly United States of America is a great name so I think we’d just go for that. Occasionally I toy around with thinking about how we could have solved that bi-lingualism burden Canada has. Like Montreal, Atlanta was a beautiful, old world city too — until November 16, 1864. I think we’d get rid of that quirky metric system, too. If you ask me, freedom isn’t divisible by ten. But that’s certainly not the kind of thing that I’d think about on Canada Day. Canada Day is a joyful day for celebration.

JC Penney tries to supersize their clothing market
The US clothing retailer recently launched a new campaign aimed at a larger target market:
You can see the commercial logic, of course. America’s obese population is growing — both numerically and horizontally — and JC Penney sells clothes. Someone has made the brilliant decision to market this once-respected brand to women who wear fumigation tents as prom dresses, and who think of Cool Ranch Doritos as a food group.
In fact, realizing how easy it is to sell to fat women I might announce a line of tea biscuits called “Milo’s Virtuous Snacks” with inspirational quotes on the boxes, such as, “You’re amazing even though you ate the whole pizza,” and, “Don’t worry that your left arm is numb, that’s just your FIERCE shining through.”
They’re $19.95 for a box of 10, but you can’t put a price on a woman’s self esteem or wellbeing. Well, JC Penney has I suppose, but my point is I too can profit from your inevitable painful death via type 2 diabetes, alone in your married sister’s attic. Of course I’m a fair bit cleverer than JC Penney: fattening up these cows will just create inventory for my other business — safari parks.
(I’m lobbying to make it legal to hunt any man over 20% body fat. But only with tranquilizer darts — I’m not a monster.)
In the long run though, this sort of business strategy doesn’t work. JC Penney is joining the ranks of consumer products companies following a bizarrely quixotic business model — help your customers feel good about themselves until they drop dead from obesity-related illnesses. The problem? When they die, they stop buying your XXXL clothing.

QotD: The dangers of expanding the government’s power
Urging vague and unconstrained government power is not how responsible citizens of a free society ought to act. It’s a bad habit and it’s dangerous and irresponsible to promote it.
This is not an abstract or hypothetical point. We live in a country in which arbitrary power is routinely abused, usually to the detriment of the least powerful and the most abused among us. We live in a country in which we have been panicked into giving the government more and more power to protect us from harm, and that power is most often not used for the things we were told, but to solidify and expand previously existing government power. We live in a country where the government uses the power we’ve already given it as a rationale for giving it more: “how can we not ban x when we’ve already banned y?” We live in a country where vague laws are used arbitrarily and capriciously.

Colby Cosh on Brexit parallels with the Canada-US relationship
In his latest column at the National Post, Colby Cosh wonders why Canadian pundits have been so strongly pro-EU when their other mode is to reject anything resembling an EU-style relationship with our own largest trading partner:
I might have voted Remain myself if my great-grandparents’ generation hadn’t lit out for the great plains, but isn’t there something obviously unusual about our view of the transatlantic frenzy? Canada is a political entity defined by its perpetual rejection of a continental political union. No one here, at all, ever expresses any doubt about the wisdom of that rejection. It costs us all hard cash, every day, to not be the 51st state. Yet we keep the Americans at bay, preserving the freedom to make arrangements on trade and defence on a basis (or pretence?) of mutual, separate sovereignty. We do this even though we share a common tongue with Americans, and they are much more similar to us culturally and ideologically than an Englishman is to an Estonian.
Look at the list of imprecations being hurled at Leave voters Friday, many of them by Canadians. They’re “small-minded,” “isolationist,” “short-sighted,” “fact-blind,” “racist” countryside boobs without vision or understanding. Couldn’t all these epithets be turned on us like a gun-barrel? Who speaks for, even contemplates, the discarded project of American Union — which was once a lively concern, actively advocated by some of the first people to call themselves Canadian in the modern sense?
If the sheer craziness of Canada’s Remain sympathies weren’t obvious enough, the intellectual leaders of the Leave camp are constantly upholding Canada as a model for immigration policy, with its self-interested, skill-privileging, but globally indiscriminate points system. They also cite us as an obvious potential partner for the kind of bilateral trade deal Britain will now be free to pursue on its own. Basically, the Leave campaigners didn’t put it this way or incorporate it into a slogan, but they want the U.K.’s relationship with Europe — a polyglot kaleidoscope of radically dissimilar nation states, some of them failing — to be the same friendly, wary relationship Canada has with the United States.
What in Hades could possibly be wrong with that, as a basic proposition?
QotD: Liberty and Democracy
Liberty and democracy are eternal enemies, and every one knows it who has ever given any sober reflection to the matter. A democratic state may profess to venerate the name, and even pass laws making it officially sacred, but it simply cannot tolerate the thing. In order to keep any coherence in the governmental process, to prevent the wildest anarchy in thought and act, the government must put limits upon the free play of opinion. In part, it can reach that end by mere propaganda, by the bald force of its authority — that is, by making certain doctrines officially infamous. But in part it must resort to force, i.e., to law. One of the main purposes of laws in a democratic society is to put burdens upon intelligence and reduce it to impotence. Ostensibly, their aim is to penalize anti-social acts; actually their aim is to penalize heretical opinions. At least ninety-five Americans out of every 100 believe that this process is honest and even laudable; it is practically impossible to convince them that there is anything evil in it. In other words, they cannot grasp the concept of liberty. Always they condition it with the doctrine that the state, i.e., the majority, has a sort of right of eminent domain in acts, and even in ideas — that it is perfectly free, whenever it is so disposed, to forbid a man to say what he honestly believes. Whenever his notions show signs of becoming “dangerous,” ie, of being heard and attended to, it exercises that prerogative. And the overwhelming majority of citizens believe in supporting it in the outrage. Including especially the Liberals, who pretend — and often quite honestly believe — that they are hot for liberty. They never really are. Deep down in their hearts they know, as good democrats, that liberty would be fatal to democracy — that a government based upon shifting and irrational opinion must keep it within bounds or run a constant risk of disaster. They themselves, as a practical matter, advocate only certain narrow kinds of liberty — liberty, that is, for the persons they happen to favor. The rights of other persons do not seem to interest them. If a law were passed tomorrow taking away the property of a large group of presumably well-to-do persons — say, bondholders of the railroads — without compensation and without even colorable reason, they would not oppose it; they would be in favor of it. The liberty to have and hold property is not one they recognize. They believe only in the liberty to envy, hate and loot the man who has it.

In case you get itchy feet after November’s election results…
Matt Welch has a few warnings for Americans of all political stripes who threaten to come to Canada if the wrong politico gets elected president this year:
* Revenge-minded border cops. Casually crossing our northern border with a family of four, as I attempted recently, is no longer a routine matter. Investigators I know who have worked with Canada’s Border Services Agency say that customs officials are ramping up their screening of Americans in advance of a possible November onslaught. And just maybe, after 15 years of U.S. border enforcers giving Canadians a harder time, followed by 12 months of a xenophobic presidential campaign, we might be getting some payback.

* You better like Canadian musicians. Americans can be forgiven for losing track of who among their beloved North American entertainers might say “oot and aboot” after a few Mooseheads. But sitting at one of Toronto’s roughly 1,000 sports bars is a grueling reminder that Canada’s Broadcasting Act, which requires that at least one-third of the content at commercial radio stations emanate from musicians with maple leafs in their passports, is a make-royalties program for the Rushes of the world. If you think American classic rock stations are repetitive, get used to side 1 of “Moving Pictures.”

* You can run from America, but you cannot hide. Think living in Montreal or Vancouver frees you up from the long arm of the Internal Revenue Service? Think again! There are two countries on this whole planet that require federal income tax filing from its nonresident citizens. Eritrea, not particularly known for its good governance, is one of them. Uncle Sam’s the other.
It gets considerably worse from there. Because of a putrid 2010 law called the Foreign Account Tax Compliance Act (FATCA for short, because Washington legislators are nothing if not subtle), U.S. citizens and their spouses who hold more than $10,000 total in non-American financial institutions must file annual disclosures listing the maximum exchange-rate value of each and every such account during the previous year. If you don’t comply, you face steep fines and even jail time.
Ostensibly aimed at fat cats, this law instead has punished the majority nonrich among America’s estimated 8.7 million expatriates. Not only does FATCA impose costly paperwork on individuals, it also requires overseas financial institutions to act as Washington’s international collections muscle, mandating that they seize and transfer to the IRS 30% of deadbeat Americans’ assets. To the surprise of no one who understands basic incentives, foreign banks have been dropping American clients like sacks of flaming garbage.
The art of the “dog whistle”
Scott Alexander on the horribly anti-semitic dog whistle that cost Ted Cruz the Republican presidential nomination (or something):
Back during the primary, Ted Cruz said he was against “New York values”.
A chump might figure that, being a Texan whose base is in the South and Midwest, he was making the usual condemnation of coastal elites and arugula-eating liberals that every other Republican has made before him, maybe with a special nod to the fact that his two most relevant opponents, Donald Trump and Hillary Clinton, were both from New York.
But sophisticated people immediately detected this as an “anti-Semitic dog whistle”, eg Cruz’s secret way of saying he hated Jews. Because, you see, there are many Jews in New York. By the clever strategem of using words that had nothing to do with Jews or hatred, he was able to effectively communicate his Jew-hatred to other anti-Semites without anyone else picking up on it.
Except of course the entire media, which seized upon it as a single mass. New York values is coded anti-Semitism. New York values is a classic anti-Semitic slur. New York values is an anti-Semitic comment. New York values is an anti-Semitic code word. New York values gets called out as anti-Semitism. My favorite is this article whose headline claims that Ted Cruz “confirmed” that he meant his New York values comment to refer to Jews; the “confirmation” turned out to be that he referred to Donald Trump as having “chutzpah”. It takes a lot of word-I-am-apparently-not-allowed-to-say to frame that as a “confirmation”.
Meanwhile, back in Realityville (population: 6), Ted Cruz was attending synagogue services at his campaign tour, talking about his deep love and respect for Judaism, and getting described as “a hero” in many parts of the Orthodox Jewish community” for his stance that “if you will not stand with Israel and the Jews, then I will not stand with you.”
But he once said “New York values”, so clearly all of this was just really really deep cover for his anti-Semitism.

QotD: Commencement speeches
This is the season of college Commencement speeches — an art form that has seldom been memorable, but has increasingly become toxic in recent times.
Two themes seem to dominate Commencement speeches. One is shameless self-advertising by people in government, or in related organizations supported by the taxpayers or donors, saying how nobler it is to be in “public service” than working in business or other “selfish” activities.
In other words, the message is that it is morally superior to be in organizations consuming output produced by others than to be in organizations which produce that output. Moreover, being morally one-up is where it’s at.
The second theme of many Commencement speakers, besides flattering themselves that they are in morally superior careers, is to flatter the graduates that they are now equipped to go out into the world as “leaders” who can prescribe how other people should live.
In other words, young people, who in most cases have never had either the sobering responsibility and experience of being self-supporting adults, are to tell other people — who have had that responsibility and that experience for years — how they should live their lives.
In so far as the graduates go into “public service” in government, whether as bureaucrats or as aides to politicians or judges, they are to help order other people around.
It might never occur to many Commencement speakers, or to their audiences, that what the speakers are suggesting is that inexperienced young graduates are to prescribe, or help to dictate, to vast numbers of other people who have the real world experience that the graduates themselves lack.
To the extent that such graduates remain in government — “public service” — they can progress from aides to becoming career politicians, bureaucrats and judges, never acquiring the experience of being on the receiving end of their prescriptions or dictates. That can mean a lifetime of people with ignorance presuming to prescribe to people with personal knowledge.

QotD: Canadians and the monarchy
Only a few Canadians are consciously passionate about monarchism. We know that our royals are Canadian mostly as a matter of constitutional metaphysics. The serious monarchists are equalled or outnumbered by those who would like us to move further toward an American form of government with a directly elected presidency, having already adopted a written constitution and an American-style judiciary.
When we embraced free trade with the United States, accusations of treason were thrown around haphazardly. The patriotism of any Canadian who merely wanted to sell and buy American things was given the stink-eye by liberal “nationalists” who had just supported a Jeffersonian bill of rights and a Marshallite Supreme Court. Now there are those who want to make a Congress out of Parliament and an official “first lady” of the prime minister’s wife: no one calls them bad Canadians.
Well, they are a little bit bad, in the sense of being negligent, because they are acting on a contradiction they do not see. What it would be hard to explain to a Roman or an Elizabethan is that our attachment to the monarchy is mostly unconscious. Its expression among most of us takes the form of mild contempt for the United States; we feel American government is ridiculous, a half-competent burlesque of Westminster-style democracy. Presidents amass more and more of the powers of an absolute monarch, more of the mythological features of a Sun King; they make increasingly ambitious religious promises to heal the sick, obtain fair weather, cultivate prosperity in the face of chance and accident.
