Roger Goodell’s dilemma
USA Today‘s Tom Pelissero updates the state of play in the Ray-Rice-is-a-terrible-human-being case:
The NFL has hired former FBI director Robert S. Mueller III to investigate the league’s pursuit and handling of evidence in the Ray Rice domestic violence case after a report Wednesday that a league executive received videotape evidence five months before it became public.
New York Giants owner John Mara and Pittsburgh Steelers owner Art Rooney will oversee the investigation, and the final report will be made public, according to league’s statement, which noted Commissioner Roger Goodell has pledged the full cooperation of NFL personnel and access to all league records.
The announcement came hours after the Associated Press published a report citing an unnamed law enforcement official who said he sent a tape of Rice punching his then-fiancée to an NFL executive long before the video surfaced on TMZ.com on Monday, leading to Rice’s release from the Baltimore Ravens and his indefinite suspension by the league.
The law enforcement official — speaking to the AP on condition of anonymity because of the ongoing investigation — also played the AP a 12-second voicemail from an NFL office number on April 9 confirming the video arrived. A female voice expresses thanks and says: “You’re right. It’s terrible.”
The NFL commissioner may have thought he’d put the Ray Rice issue behind him after the elevator video was released to the public, but now it’s being alleged that the league actually did get a copy of the video before Goodell suspended Rice for a token two-game stretch. Ace thinks this might have been Goodell’s reasoning for doing as he did:
Could that be Goodell’s spin? “I knew about it, but I had to protect a source”?
Although this spin won’t save Goodell, part of his thinking might have been this:
1. This punch is atrocious, a potentially lethal full-on boxer’s knockout punch.
2. However, the evidence of this is currently being withheld from the public by law.
3. Even though I know about this tape, I cannot use it as the basis for my decision, as it is in my hands illegally.
4. Further, I could not explain to the public, nor to the NFL Player’s union, the reasons for a severe punishment, because they would cry foul and cry “PC over-punishment!” unless they see this horror in real time, which I have seen, but they have not, and maybe never will.
I don’t know if that’s what they were thinking (assuming Goodell saw it, and frankly, I don’t know how he could not have seen it — This is his job; punishing a player for an infraction is not something you delegate to the branch office in Cincinnati like Lois Lerner did (wink, wink)), and I doubt this would cut much ice even it it were.
Even if Goodell didn’t think he could suspend Rice indefinitely absent the public unveiling of the tape — Two Game Suspension? When another guy just got a four game suspension for some minor substance abuse rap?

Katie Nolan – Why boycotting the NFL because of Ray Rice is not the answer
I haven’t watched the latest video of Ray Rice being an embarrassment to humankind, nor do I intend to. I think the NFL has made major errors in how they’ve handled the whole situation, and I don’t think it’s over yet, even with Rice out of football (because Rice is certainly not the only offender … he’s just the one we know the most about right now). Katie Nolan offers her insight into why the NFL still doesn’t understand how seriously they’ve fumbled this issue:

NFL Commissioner Roger Goodell said he never saw the elevator video of Ray Rice striking his then-fiancee until Monday morning, but when he did, he found it “sickening,” he told USA TODAY Sports in a telephone interview Tuesday evening.
He also said that Rice and his representatives told him a different story about what happened in the Atlantic City elevator than what he saw on the video. While he would not reveal those details, he called them “ambiguous.”
“There was no ambiguity when you saw that tape (Monday),” he said. “It was sickening. It was appalling. It was clear that it was not consistent with what they presented to us in the hearing and we needed to take the right step which is to indefinitely suspend him.”
Goodell said he and his staff saw the first video in February, the one in which Rice is seen dragging Janay Palmer’s listless body out of the elevator. They “suspected” there was another, and tried to obtain it.
“We asked for it on multiple occasions,” Goodell said. “We asked law enforcement and they were not willing to provide it. I think they were under some legal requirements not to provide it, as I understand it.”
A spokesman for the New Jersey state attorney general addressed on Tuesday the issue of why the video was not released to the NFL.
“It’s grand jury material. It would have been improper — in fact, illegal — for the Atlantic County Prosecutor’s Office to provide it to an outside/private/non law-enforcement entity,” Paul Loriquet said, according to ABC News.
Ontario’s bid to impose a Netflix or YouTube tax
Michael Geist reports on the Ontario government’s pitch to the CRTC to impose additional tax burdens on foreign online video services:
As CRTC Chair Jean-Pierre Blais anticipated, the Government of Ontario’s call for regulation of online video services attracted considerable attention, including comments from Canadian Heritage Minister Shelly Glover roundly dismissing the possibility. Glover stated:
“We will not allow any moves to impose new regulations and taxes on internet video that would create a Netflix and Youtube Tax.”
Last night, I received an email from a spokesperson for Ontario Minister of Tourism, Culture and Sport Michael Coteau that tried to soften the call for online video regulation. The spokesperson stated:
“The presentation today provided important elements for CRTC consideration as it undertakes its review. The government is not advocating for any CanCon changes, or that any specific regulations be imposed on new media TV, until more evidence is available.”
I asked for clarification on what “more evidence” means. The spokesperson responded that there will be over 100 presentations at the CRTC hearing and that all need to be heard from before moving forward.Yet a review of the Ontario government submission to the CRTC and its prepared remarks yesterday make it clear that the government strongly supported immediate regulatory reforms and that the need for “evidence” is actually a reference to revenue thresholds that would trigger mandatory payments by foreign online video providers.
Ruining royal reputations – it didn’t start on Fleet Street
In Maclean’s, Patricia Treble reviews a new book by Jonathan Beckman, called How to Ruin a Queen: Marie Antoinette and the Diamond Necklace Affair:
Three years before revolutionaries toppled Louis XVI and his Austrian-born wife, Marie Antoinette, France was mesmerized with a different tumult. Cardinal Louis de Rohan, scion of one of the nation’s grandest families, was in court, accused of stealing a famously expensive necklace from jewellers who’d created it. He claimed he’d acted at the behest of the queen, who then reneged on paying for the gaudy 2,800-carat piece. The resultant scandal solidified Marie Antoinette’s reputation for unbounded extravagance.
Yet, as Jonathan Beckman, explains in a masterful new account of the diamond necklace affair, nothing is as it appeared. There are fake royals, forged letters and disappearing gems as well as kidnappings, trysts and even a duel involving poisoned pigs. If the tale was fictional, it would be dismissed as an overwrought fantasy, yet in Beckman’s hands, its machinations unfold as an audacious caper that will enthrall readers much as the original events captivated Europe.

QotD: The Economist‘s whitewash of the “Great Leap Forward”
When Mao died, The Economist wrote:
“In the final reckoning, Mao must be accepted as one of history’s great achievers: for devising a peasant-centered revolutionary strategy which enabled China’s Communist Party to seize power, against Marx’s prescriptions, from bases in the countryside; for directing the transformation of China from a feudal society, wracked by war and bled by corruption, into a unified, egalitarian state where nobody starves; and for reviving national pride and confidence so that China could, in Mao’s words, ‘stand up’ among the great powers.” (emphasis mine)
The current estimate is that, during the Great Leap Forward, between thirty and forty million Chinese peasants starved to death. Critics questioning that figure have suggested that the number might have been as low as two and half million.
I am curious — has the Economist ever published an explicit apology or an explanation of how they got the facts so completely backwards, crediting the man responsible for what was probably the worst famine in history with creating a state “where nobody starves?” Is it known who wrote that passage, and has anyone ever asked him how he could have gotten the facts so terribly wrong?

Tracey Thorn describes the performance of Kate Bush
In the New Statesman, Tracey Thorn laments that she’s lost an excuse for not doing live performances herself and loses herself in the performance at the Hammersmith Apollo in London:
Six straight songs and then, just as we are relaxing, the stage transforms, and the drama begins: a multi-sensory performance of “The Ninth Wave”, the suite of songs that forms side two of The Hounds of Love (1985). There’s Kate on screen in a life jacket, apparently slipping away from us, singing “And Dream of Sheep”, one of her most beautiful songs.
I should probably write this somewhere more formal – my will, perhaps – but in case I forget, let me say here that I would be happy for you to play this song at my funeral. I weep as she sings it, partly because I’m imagining my own funeral, but also because we are witnessing a struggle between life and death, where a drowning woman yearns to be saved, to return to her beloved family. “Let me live!” she cries a few songs later. Overwhelming and exhilarating as they are, all the special effects – Kate in a tank, a helicopter search beam strafing the audience – are in the service of the songs and the story.
Why is it so moving? Well, because when finally she is brought back it is not just the fictional heroine, but Kate herself who has survived the years, and those cold seas, and returned to us. The two strands, family love and audience love, intertwine as she shows us how both mean so much to her. “D’you know what?/I love you better now,” she sings, as the first half ends and we wipe our tears.
Part two is calmer, more reflective, consisting of one side of the recent album Aerial (2005). Reprieved from death, she now revels in the simple, sensuous pleasures of life. Birdsong on a summer afternoon. The setting of the sun and the rising of the moon. In more conventional hands this could be merely decorous and pastoral, even a little twee, but somehow she has found a way to transform contentment into euphoria. The mood is hypnotic, rhythmic and trancey, and the stage dazzles with images of light and flight; less genteel garden party, more full-on midsummer rave, it could be the ultimate blissed-out headliner of a blistering, sunny Glastonbury.
And her singing voice, which I so worried about? It is a thing of wonder, any youthful shrillness replaced by a richer, occasionally gravelly tone, and with a full-throated power unbelievable in someone who has so rarely sung live. All I can think is that she must have been practising, on her own in a barn somewhere, for the past 35 years. Practising, planning, waiting for all the stars to align – her own desire, the cast of collaborators, the right time and place – in order for this to happen. And it is an ecstatic triumph, a truly extraordinary achievement.
QotD: TV documentaries
Is it just me or are almost all TV documentaries completely unwatchable these days? I remember when I first started this job I’d review one almost every fortnight. Always there’d be something worth watching: on the horrors of the Pacific or the Eastern Front, say; or castles; or Churchill; or medieval sword techniques. But now it’s all crap like The Hidden World of Georgian Needlecraft or In The Footsteps of Twelve Forgotten South American Civilisations Which All Look The Same or A Brooding, Long-Haired Scottish Geographer Shouts From Inside A Volcano Why Climate Change Is Worse Than Ever.
The presenters have got more annoying too. I mean, I’m not saying some of the old ones weren’t infuriating with their hand-waving and tics and mannerisms and wheezings. But the new ones are just vacuous, unformed squits. They make you yearn for a reverse Logan’s Run world, where everyone under 30 is executed for being so tiresome. A lot of them are women, obviously, chosen mainly for their simpering looks and charming speech impediments and unerring knack for fronting the dullest imaginable subject matter.
No doubt the people responsible for commissioning this drivel think they’re redressing the balance, in much the same way progressive historians do when they demand we empathise with medieval peasants rather than learning about what Edward I did to the Welsh and the Scots. Well, I can’t speak for all oppressed women here, but I think I can for my wife. They’re not going, ‘Oh, good. Finally a documentary with my name on it, about what it was like to be a woman’s maidservant in Elizabethan York.’ They’re going, ‘Who is that irritating little cow? Why is she on the screen putting on that little-girl-lost voice for my husband? And why the hell isn’t this documentary about something actually interesting, like, say, castles, or Churchill or medieval sword techniques?’

The new absolutism
Brendan O’Neill on the rise of the absolutist mindset in science:
Who do you think said the following: “I always regret it when knowledge becomes controversial. It’s clearly a bad thing, for knowledge to be controversial.” A severe man of the cloth, perhaps, keen to erect a forcefield around his way of thinking? A censorious academic rankled when anyone criticises his work? Actually, it was Brian Cox, Britain’s best-known scientist and the BBC’s go-to guy for wide-eyed documentaries about space. Yes, terrifyingly, this nation’s most recognisable scientist thinks it is a bad thing when knowledge becomes the subject of controversy, which is the opposite of what every man of reason in modern times has said about knowledge.
Mr Cox made his comments in an interview with the Guardian. Discussing climate change, he accused “nonsensical sceptics” of playing politics with scientific fact. He helpfully pointed out what us non-scientific plebs are permitted to say about climate change. “You’re allowed to say, well I think we should do nothing. But what you’re not allowed to do is to claim there’s a better estimate of the way that the climate will change, other than the one that comes out of the computer models.” Well, we are allowed to say that, even if we’re completely wrong, because of a little thing called freedom of speech. Mr Cox admits that his decree about what people are allowed to say on climate change springs from an absolutist position. “The scientific view at the time is the best, there’s nothing you can do that’s better than that. So there’s an absolutism. It’s absolutely the best advice.”
It’s genuinely concerning to hear a scientist — who is meant to keep himself always open to the process of falsifiabilty — describe his position as absolutist, a word more commonly associated with intolerant religious leaders. But then comes Mr Cox’s real blow against full-on debate. “It’s clearly a bad thing, for knowledge to be controversial”, he says. This is shocking, and the opposite of the truth. For pretty much the entire Enlightenment, the reasoned believed that actually it was good — essential, in fact — for knowledge to be treated as controversial and open to the most stinging questioning.
A deluge of public domain images
Techdirt‘s Mike Masnick alerted me to a new source of old images:
Here’s some nice news. Kalev Leetaru has been liberating a ton of public domain images from books and putting them all on Flickr. He’s been going through Internet Archive scans of old, public domain books, isolating the images, and turning them into individual images. Because, while the books and images are all public domain, very few of the images have been separated from the books and released in a digital format.
There are all sorts of images in this stream, so you never know what you’ll find when you dive in. Here, for example is an image used in Canadian grocer January-June 1908:

British government “austerity”
Theodore Dalrymple explains why changing the name of something does not actually change the thing being described, no matter how much politicians or journalists wish it did:
… some errors are important, and one sees them more insistently the older one grows. For example, the other day I read an article in Le Monde about the forthcoming referendum in Scotland on independence from the United Kingdom. The author of the article was clearly sympathetic to the cause of independence, but that was not the cause of my irritation with the article, nor the fact that he quoted an old man, a former trade union militant, who said that he was in favor of independence, among other reasons, because the United Kingdom was the fourth most unequal country in the world. If old men in Scotland can be as ignorant of the world as that, it is an interesting sociological observation; and the author of the article is almost certainly right that those in favor of Scottish independence favor a state even more extensive in the name of equality than the one that they already have.
No, I was irritated rather by the fact that the author of the article accepted that the policy of the present British government can properly be described as one of austerity. What the alleged austerity amounts to is this: that in the current year the government will borrow only one in six of the pounds it spends instead of one in five, as it did last year. As to the reasons for this less than startling decline in its borrowing requirements, it was not because the government was spending less but because it was receiving more taxes, from the speculative housing bubble which it has done much to fuel. If that bubble should burst, the borrowing necessary to maintain current levels of expenditure (already very high) would rise again, possibly higher than ever.
This is not a question of whether the economic policy followed by the government is the right one or not: perhaps it is and perhaps it isn’t. It is a question of the honest use of words. One would not say of a man who passed from smoking sixty cigarettes a day to fifty that he had given up smoking, or that he had exercised great self-denial. And one would not, or rather should not, say of an organization that had balanced its budget once in fifty years (the British government) that it was practicing austerity merely because it had to borrow a slightly lower percentage of what it spent than it did the year before. This is to deprive words of their meaning.
But does this matter? As the philosopher Bishop Butler once said, everything is what it is and not another thing. A budget deficit is a budget deficit, whether you call it profligacy or austerity. A thing is not changed by being called something different.
Unfortunately, matters are not quite as clear-cut as that. In human affairs, words matter, as much because of their connotations as of their denotations. Austerity means stern treatment and self-discipline. It means harshness and astringency. Needless to say, harshness in their government is not what most people look or will vote for. If reducing the rate at which you overspend and accumulate debt is called austerity, no one will dare go any further in that direction, though it were the right direction in which to go. Words, said Hobbes, are wise men’s counters but the money of fools: so that many men will take the name for the thing itself. Whether more active attempts to balance the budget would be advisable I leave to economists to decide (they can’t, of course).

QotD: 1960s folk music
I always love it when some record from the “Sixties folk music boom” comes on the radio, and one can wallow for three minutes in comically twee clean-cut earnestness: the Kingston Trio, Peter, Paul and Mary, the Brothers Four and all the other college boys pretending to be field-hands. As for the songs, I quoted in my Seeger send-off this trenchant analysis of his lyric style by James Lileks:
‘If I Had A Hammer’? Well, what’s stopping you? Go to the hardware store; they’re about a buck-ninety, tops.
Just so. Anyone can have a hammer, and hammer in the morning, hammer in the evening, hammer out danger, hammer out a warning, hammer out love between one’s brothers and one’s sisters all over the land.
But, upon reflection, the fact that the thought is idiotic is, I think, the point. If it made sense, it would sound too polished, too written, too Tin Pan Alley. It can’t be easy sitting in your study and writing brand-new “folk” songs when you’re a long way from the cotton fields. So somehow these guys got it into their heads that, if you sounded like a simpleton, it would come over as raw and authentic. I once spoke to a Vegas pal of Bobby Darin’s, who gave an hilarious account of Darin, coming out of his finger-snappy tuxedo phase, and agonizingly re-writing and re-re-writing his “folk anthem” “A Simple Song Of Freedom” because he was worried it was insufficiently simple.
The legacy of this period is less musical than political: half-a-century back, the self-consciously childlike “folk song” met the civil rights movement and helped permanently infantilize the left. I caught an “anti-war” protest in Vermont a few years ago and the entire repertoire was from the Sixties, starting with “Where Have All The Flowers Gone?”, which as a poignant comment on soldiering was relevant in the Great War but has no useful contribution to make in a discussion on Iraq. And, as I observed of Pete Seeger’s visit to the “mass” protest movement of our own time, the more pertinent question with the Occupy Wall Street crowd is “Where have all the showers gone?”

No lose betting – predictions in the media
Back in 2010, Dan Gardner pointed out that the “risky” business of making predictions to the media is actually a no-lose proposition almost all the time:
We’re coming to the end of the year and the pundits are lining up to tell us what’s going to happen in the one to follow. And why not? People want to hear predictions. And for the expert, there’s no way he can lose. If the prediction hits, he can boast about it and reporters will cite it as proof of his wisdom. But if it misses, no one will ever hear about it again.
Heads, I win. Tails, you forget we had a bet.
Of course the rules of the game would be a little different if, at the end of the year, instead of asking for new predictions, we looked back at what was predicted to happen in the year ending. Think of it as holding people to account for the predictions they make.
So let’s get on with the humiliation.
Whoah! Did I write that? I meant “fair and judicious review of past predictions.” Or, as this exercise might more accurately be described, “a bunch of predictions presented in no particular order and selected for no reason other than that they made me smile.”

35 years later, Kate Bush returns to live performances
BBC News reports on the first live performance by Kate Bush since 1979:
Kate Bush has made her stage comeback to an ecstatic response from fans at her first live concert for 35 years.
Bush received a standing ovation as she closed the show with Cloudbusting, from her 1985 hit album The Hounds of Love.
The 56-year-old British star was appearing at London’s Hammersmith Apollo — the scene of her last live show in 1979.
Tuesday’s three-hour set kicked off a run of 22 shows, titled Before the Dawn, which sold out in minutes.
Afterwards, she thanked fans for their “warm and positive response”.
Backed by seven musicians, Bush opened the show with Lily, from the 1993 album Red Shoes.
There was a huge roar from the crowd as Bush appeared on stage — barefoot and dressed in black — leading her five backing singers.
“It’s so good to be here — thank you so much,” she told the cheering crowd.
She later introduced one of the backing chorus as her teenage son Bertie who, the star said, had given her the “courage” to return to the stage.
The first half of the show included the 1985 single Running Up That Hill and, from the same Hounds of Love album, the song suite The Ninth Wave — which combined video, theatre and dance to tell the story of a woman lost at sea.
After an interval, the second act was dominated by songs from Bush’s 2005 album Aerial.

Reason.tv – P.J. O’Rourke on Millennials and Baby Boomers

“Just this whole process of going through the baby boom’s history, I began to realize what a nicer society — kinder, more decent society — that we live in today than the society when I was a kid,” says P.J. O’Rourke, best-selling author of Holidays in Hell, Parliament of Whores, and many other titles.
O’Rourke sat down with Reason‘s Nick Gillespie at Freedom Fest 2014 in Las Vegas to discuss his new book, The Baby Boom: How it Got That Way and It Wasn’t My Fault and I’ll Never Do it Again. As the father of three kids born between 1997 and 2004, he also lays down some thoughts about millennials, noting that they live in a much nicer, more tolerant world than the one in which he grew up. “I don’t think my 10-year old boy has ever been in a fist fight,” says O’Rourke, who was born in 1947. “I mean there might be a little scuffling but I don’t think he’s has ever had that kind of violent confrontation that was simply part of the package when I was a kid.”
He also feels that the internet “fragments information” in a way that destroys the sweep of history, at least at first. “You end up with mosaic information,” he says. “Now, I think over time the kids put these mosaics together but I don’t think the internet itself lends itself to the sweep of history.”
The interview also includes a tour of O’Rourke’s long and varied career in journalism, from his humble beginnings writing for an underground alt-weekly to his time as editor of National Lampoon and his incredible work as a foreign correspondent for Rolling Stone to his current position as columnist at the Daily Beast.
A prominent libertarian, O’Rourke also discusses the difficulties in selling a political philosophy devoted to taking power away from politicians.
“If libertarianism were easy to explain and if it weren’t so easy to exaggerate the effects of libertarianism — people walking around with ‘Legalize Heroin!’ buttons and so on — I think it would’ve been done already,” says O’Rourke. “But the problem is, of course, is that libertarianism isn’t political. It’s anti-political, really. It wants to take things out of the political arena.”
