The “Catch-22” in RBG’s majority opinion in City of Sherrill V. Oneida Indian Nation of N.Y.

In 2005, in the case of the City of Sherrill V. Oneida Indian Nation of N.Y., the U.S. Supreme Court ruled against the Oneidas, after the nation had attempted to assert sovereignty in traditional land they had to re-purchase after it had been illegally acquired.

Writing the majority position was the late liberal figurehead now being lionized in U.S. media — Ruth Bader Ginsburg.

Granted, she fought for women’s rights and accomplished a lot. She was a law school professor and a judge. She was one of the leaders of the American Civil Liberties Union. She was the second woman to ever serve on the United States Supreme Court. She was influential in a lot of cases on the Supreme Court, including a labour law case that inspired a law to be passed, and an environmental case that set new standards for who could be heard in court on environmental issues. Since her recent death, the news coverage has been singing her praises like hagiography.

But study history and you will find lots of villains, and no saints. Many First Nations people in North America look on Ginsburg’s reification with a much more skeptical eye.

Meanwhile, the sovereignty of many Indigenous nations in B.C. has never been extinguished. Many First Nations here are being corralled into signing treaties that give up lands, rights and sovereignty. They may look to the Oneida as a cautionary tale. When it comes to sovereignty, you must use it or lose it. Don’t look to courts to give it back later. Not even when you have a social justice saint for a judge.

Ginsburg ruled that Indian land in central New York acquired in violation of U.S. federal law, a treaty, and the U.S. Constitution, could not be reintegrated into the ancestral lands of the Oneida Indian Nation — that the Oneidas would be required to pay property taxes to the local government of the City of Sherill. That is, unless the Oneidas sacrificed that land and allowed the federal government to administer it as a trust.

Justice Ginsburg wrote that 200 years had passed since the initial illegal acquisition, the land had passed hands between jurisdictions multiple times over the period, and that the Oneida had just waited too long. (Even though the U.S. Supreme Court acknowledged in 2005 that there was no specific time limit on this kind of case.) She claimed in her opinion that it would just be “unfair” to the non-natives in this case. If the Oneida had sued in court sooner, then it would have been different.

In the long and fraught web of relationships between First Nations and the United States government, it’s hard to pick a time before the late 20th century or early 21st where a First Nations case might be given full and fair hearing by any federal court, which shows Ginsburg’s opinion to be … lacking in historical sensitivity.

Fallen flag — the Toronto, Hamilton & Buffalo Railway

This month’s Classic Trains featured fallen flag is my favourite Canadian railway … I founded the TH&B Railway Historical Society many years ago (you can download a PDF of the first newsletter I did here … I didn’t have access to any TH&B photo I could use in the publication at that point, so it’s pretty much all text and tables). I put together as much information as I had about the railway at that time and printed up a few hundred copies to distribute at a regional railfan event (the CN Lines event in Oakville during October 1997), hoping to find fellow fans of the TH&B (back in those long-distant days when you couldn’t just run a quick search from your web browser, and most people didn’t yet have email addresses). The gamble worked and we had a formal historical society up and running for the following issue. I published the newsletter for five years before finally burning out and handing it over to more capable hands.

The society is still in operation, and the newsletter (now called The Ontarian) is mailed out four times per year. Membership information available at the society website.

Greg McDonnell begins the article with a quick look at the TH&B’s early history:

Canada, thanks to its two transcontinental giants after 1923, had few small “regional” railroads. One, though, was the 111-mile Toronto, Hamilton & Buffalo Railway, which vanished in 1987.

Little TH&B had a larger-than-life presence that belied the reality of its being merely the southern Ontario stepchild that linked parents New York Central and Canadian Pacific. TH&B never realized its dream of being an independent road linking its three namesake cities, but in its heyday, it did haul sleeping cars from Toronto for New York, Boston, Cleveland, Pittsburgh, and Philadelphia. In 1911, it became the first North American railroad to install Absolute Permissive Block signaling; it erected a splendid art deco station and office tower in Hamilton, Ontario; and it had Canada’s only 2-8-4 steam locomotives, not to mention two ex-NYC Hudsons.

In 1890, even before a rail was laid, TH&B deviated from its chartered intentions, dropping Buffalo from its plans in favor of an eastern terminus and connection with the Canada Southern, a subsidiary of NYC’s Michigan Central, at Welland, Ontario. In 1892, TH&B acquired its first operating trackage, the faltering 18-mile Brantford, Waterloo & Lake Erie, a Brantford–Waterford line that was extending itself to Hamilton.

As crews spiked TH&B rails from Hamilton to Welland, the line’s strategic importance attracted suitors. And not just anyone, for on July 9, 1895, the still-incomplete railway was sold to a consortium headed by two of the most powerful men in North American railroading: NYC’s Cornelius Vanderbilt and CPR’s William Van Horne.

NYC, dividing its holdings with subsidiaries MC and CASO, took a 73% stake in the fledgling bridge line; CP held the remaining 27%, an arrangement that would endure for 80-plus years. TH&B was afforded a considerable measure of autonomy, but parental influence from New York and Montreal gave TH&B its unique international character.

The TH&B Society picks up the history in somewhat more detail (the original draft was mine, but several others have made additions and changes since then):

The next phase of construction was to be the line from Hamilton to Toronto. The surveyed route to Toronto closely paralleled the existing Grand Trunk Railway mainline. In order to avoid construction of a parallel line (and the potential loss of traffic to the competing line), the GTR granted running rights to the Canadian Pacific Railway between Toronto and Hamilton in 1896. That same year the TH&B constructed what became known as the Hamilton Connection between its line and the GTR at Hamilton Junction. The Hamilton Connection was subsequently leased to the CPR and became their physical connection to the TH&B.

In 1897, the TH&B obtained running rights over the Hamilton & Dundas Railway for the provision of freight service into the Town of Dundas. The H&D Railway, a local interurban line, ceased operations in 1923 and the TH&B acquired the former H&D right of way into Dundas to continue freight operations. The line into Dundas was known as the H&D Branch.

In order to tap into Hamilton’s expanding industrial sector, construction began on the Hamilton Belt Line in 1900. The Belt Line expanded with the construction of two additional branch lines in 1911 to allow access to all industrial sectors of the city, many of which were previously serviced exclusively by the GTR. Although the Belt Line was only six miles in length, it contained over 40 miles of yard and industrial sidings and would provide much financial sustenance to the TH&B over the years.

In 1914, the 14-mile Dunnville Subdivision was constructed southward from Smithville to the Town of Dunnville and extended five miles further to the shores of Lake Erie at Port Maitland in 1916. Access to Lake Erie allowed the creation of the TH&B Navigation Co. that operated between Port Maitland and Ashtabula, Ohio, from 1916 until discontinuance in 1932.

The TH&B’s final expansion occurred in 1927 when running rights were awarded over the Canadian National Railways to gain access to the industrial City of Port Colborne.

1935 saw the first abandonment of trackage when the Ridgeville Spur, a small four-mile branch extending off the Welland Subdivision just outside of Welland, was abandoned and the rails were removed in 1936.

The St. Lawrence Seaway Authority completed the construction of the present-day Welland Canal in 1972 resulting in the relocation of several rail lines in the area. The Welland Subdivision was realigned between Fenwick and Welland where a new yard was constructed and operated in conjunction with New York Central’s corporate successor, Penn Central. The new shared facility allowed the closure and removal of the original and independent TH&B and Penn Central operations located within the city. Welland Yard continues to operate today as a Canadian Pacific’s marshalling facility for the Niagara Region.

In 1976, the United States Government amalgamated six bankrupt railroads, including the New York Central’s corporate successor, Penn Central, into a new entity called Conrail. In an effort to reduce debt, Conrail began shedding foreign investments including their controlling interest in the TH&B. In 1977, CP Rail acquired Conrail’s 73% interest giving CP 100% control of the railway.

In 1985, CP Rail and Canadian National jointly acquired the assets of Conrail’s Canada Division, the former Canada Southern Railway. CP Rail acquired exclusive ownership of the eastern end of the line between the TH&B connection at Welland and the international border crossings at Niagara Falls and Fort Erie, Ontario. While CP equipment was used to operate this portion of the line, known as CP CASO, the TH&B provided the managerial and administrative functions on CP Rail’s behalf.

The TH&B would continue to operate as a separate entity until 1987 when it was amalgamated into the Eastern Region of the London Division of CP Rail.

CP Rail abandoned the H&D Branch in 1988 with the Waterford Subdivision following in 1989. Also in that year, CP discontinued operations into Port Colborne, opting not to renew the running rights agreement over the CNR.

Today, the surviving portions of the TH&B, including the Hamilton Belt Line, the former Welland Subdivision and a portion of the Dunnville Subdivision operate as part of Canadian Pacific’s Hamilton Subdivision in CPR’s Southern Ontario Service Area.

Amazon’s HQ$2Bn decision

If you had any doubt that the Amazon HQ2 competition was about anything other than trolling for economic bribes, this should banish the thought:

Amazon is getting some prime real estate.

In exchange for more than $2 billion in economic incentives, the online shopping giant will locate a pair of new corporate headquarters just across the Potomac River from Washington, D.C., and just across the East River from Manhattan. Tuesday’s much-anticipated announcement of the locations for Amazon’s “HQ2” also included details — which had previously been kept from the public — about the economic incentives that successfully lured the Seattle-based firm to the east coast’s political and economic hubs.

Amazon says it will invest $5 billion and create more than 50,000 jobs across the two new locations, with at least 25,000 employees at each of its new corporate campuses, to be located in Virginia’s Crystal City and New York’s Long Island City. Nashville wins a consolation prize: a new supply chain and logistics center that promises 5,000 jobs in exchange for $102 million in economic incentives.

In New York, Amazon will receive $1.2 billion in refundable tax credits through a state-level economic development program and a cash grant of $325 million that’s tied to the construction of new buildings at the Long Island City location over the next 10 years. In Virginia, the state is ponying up $573 million in tax breaks tied to the creation of 25,000 jobs, and the city of Arlington will provide a cash grant of $23 million over 15 years funded by an existing tax on hotel rooms.

Yes, the numbers are staggering — New York state’s pledge of $1.52 billion for 25,000 jobs works out to more than $60,000 in taxpayer support per new job created — but Amazon appears to have selected New York and the D.C. area based on more than just how many zeroes local officials agreed to put on the giant cardboard check.

After all, New Jersey offered Amazon $5 billion (with another $2 billion from Newark), and Maryland offered $8.5 billion. Yet Amazon passed them both over to pick their neighbors.

Rensselaer Polytechnic Institute makes Title IX applicable to non-students

I only know about Rensselaer Polytechnic Institute due to the model railway club on campus, but the school should be more widely known now, if only as an object of derision:

Today, we’re writing about RPI’s attempt to subject a student from a different school to its disciplinary process — an attempt we’re only learning about because a court had to order RPI to stop violating the rights of John Doe (who used a pseudonym in his lawsuit). In a Nov. 6 ruling in Doe’s favor, a New York state court judge deemed RPI’s conduct “arbitrary” and “capricious,” and annulled RPI’s finding that Doe had sexually assaulted an RPI student.

This story begins in 2015 when Doe, a graduate student at a school that is not RPI, was in a relationship with an RPI student. Doe had never been a student at RPI. His only connection to RPI was his relationship with an RPI student. In the summer of 2016, after the relationship ended, the RPI student filed a Title IX complaint with RPI against Doe. As the court would later observe, the alleged conduct at issue in this case “took place off campus and was not in anyway (sic) related to an educational program or activity of RPI,” and that RPI “would have learned this from the complaint itself and statements made by the complainant.” Despite this, RPI launched an of Doe and interviewed him. Per the court, the interview constituted “a clear violation of [Doe’s] constitutional rights.”

It is not difficult to see why the interview raised concerns with the court. First, RPI conveniently failed to tell Doe why it needed to interview him in advance. Doe didn’t find out about the purpose of the meeting until just before it started, when RPI’s interviewers gave him some documents and told him he was the subject of misconduct investigation. If that weren’t enough to raise due process concerns, it was also “obvious” to Judge Raymond J. Elliott that there was “a language and a possible cultural barrier” between Doe and RPI’s interviewers. So RPI hauled Doe in for questioning without telling him why, sprung a serious charge on him, and failed to ensure that he understood what was going on.

But to say the court generally sided with Doe would be an understatement.

Most importantly, the court ruled that RPI went too far in asserting jurisdiction over Doe and subjecting him to its disciplinary process. The court held that RPI should not have interviewed him or included his statement in its report. The remedy in this case was voiding Doe’s statement, and because RPI relied on Doe’s statement, the court annulled the report. The court also found that RPI had “no legal authority or obligation … to report, inform, publish or share any information or documentation with [Doe’s] academic institution regarding this alleged incident, and that [RPI’s] determination that they have the authority to do so is arbitrary and capricious.”

QotD: A key drawback of a cashless society

When I was just starting out as a journalist, the State of New York swooped down and seized all the money out of one of my bank accounts. It turned out — much later, after a series of telephone calls — that they had lost my tax return for the year that I had resided in both Illinois and New York, discovered income on my federal tax return that had not appeared on my New York State tax return, sent some letters to that effect to an old address I hadn’t lived at for some time, and neatly lifted all the money out of my bank. It took months to get it back.

I didn’t starve, merely fretted. In our world of cash, friends and family can help out someone in a situation like that. In a cashless society, the government might intercept any transaction in which someone tried to lend money to the accused.

Unmonitored resources like cash create opportunities for criminals. But they also create a sort of cushion between ordinary people and a government with extraordinary powers. Removing that cushion leaves people who aren’t criminals vulnerable to intrusion into every remote corner of their lives.

We probably won’t notice how much this power grows every time we swipe a card instead of paying cash. The danger is that by the time we do notice, it will be too late. If we want to move toward a cashless society — and apparently we do — then we also need to think seriously about limiting the ability of the government to use the payments system as an instrument to control the behavior of its citizens.

Here are some tax cuts that would actually hurt the wealthy

Last week, Kevin Williamson outlined a couple of tax reforms that really would make a difference, being both more fair to all taxpayers and appealing (in theory) to both left and right:

Congressional Republicans and the Trump administration will disagree about many things, but it is rare to find a Republican of almost any description who will turn his nose up at a tax cut of almost any description. As Robert Novak put it: “God put the Republican Party on earth to cut taxes. If they don’t do that, they have no useful function.” And tax cuts are coming. But there are two proposals in circulation that would constitute significant tax increases — tax increases that would fall most heavily on upper-income Americans in high-tax progressive states such as California and New York. The first is a proposal to reduce or eliminate the mortgage-interest deduction, a tax subsidy that makes having a big mortgage on an expensive house relatively attractive to affluent households; the second is to reduce or eliminate the deduction for state income taxes, a provision that takes some of the sting out of living in a high-tax jurisdiction such as New York City (which has both state and local income taxes) or California, home to the nation’s highest state-tax burden.

Do not hold your breath waiting for the inequality warriors to congratulate Republicans for proposing these significant tax increases on the rich. Expect lamentations and the rending of garments, instead.

Slate economics editor Jordan Weissmann, who is not exactly Grover Norquist on the question of taxes, describes the mortgage-interest deduction as “an objectively horrible piece of public policy that should be reformed,” and it is difficult to disagree with him. It distorts the housing market in favor of higher prices, which is great if you are old and rich and own a house or three like Bernie Sanders but stinks if you are young and strapped and looking to buy a house. It encourages buyers to take on more debt at higher interest rates than they probably would without the deduction, and almost all of the benefits go to well-off households in the top income quintile. It is the classic example of upper-class welfare. And it has a nasty side, too: Those sky-high housing prices in California’s most desirable communities serve roughly the same function as the walls of a gated community or the tuition at Choate: keeping the riff-raff out. Pacific Heights is famous for its diversity: They have all kinds of multimillionaires there.

QotD: The spendthrift governor, Nelson Rockefeller

In 15 years as governor of New York, Nelson A. Rockefeller, popularly known as “Rocky,” was as careful with the public’s money as he was with his own — which is to say, he spent lavishly, impulsively, and often indiscriminately. New Yorkers have been paying the bill ever since. As portrayed in Richard Norton Smith’s new biography, Rockefeller believed that there was no problem (least of all a lack of cash) too big to yield to a big-money solution. “As much as I loved Nelson,” Smith quotes the financier Frank Zarb, “his meter didn’t start until you reached a billion dollars.”

Rocky’s meter began to spin soon after he became governor of New York in 1959, and it accelerated as time went on. To be sure, every level of American government was expanding during the 1960s and 1970s. But Rockefeller made an outlier of the Empire State. He quadrupled the state budget and quintupled state debt, including off-the-books public-authority borrowing. He created the nation’s most lavish Medicaid program, designed to draw down maximum federal aid to the state while saddling New York City and county governments with half the non-federally reimbursed cost. He pushed through a collective bargaining law that would bequeath to New Yorkers the nation’s highest level of public-sector unionization. Though New York had been a cradle of open-handed liberalism, its state and local taxes, relative to personal income, were slightly below the national average when Rockefeller took office, according to Census data.
