QotD: The prohibitionists

This notion, I believe, is at the bottom of much of the current pathetic faith in Prohibition. The thing itself is obviously a colossal failure — that is, when viewed calmly and realistically. It has not only not cured the rum evil in the United States; it has plainly made that evil five times as bad as it ever was before. But to confess that bald fact would be to break the forward-looking heart: it simply refuses to harbor the concept of the incurable. And so, being debarred by the legal machinery that supports Prohibition from going back to any more feasible scheme of relief, it cherishes the sorry faith that somehow, in some vague and incomprehensible way, Prohibition will yet work. When the truth becomes so horribly evident that even forward-lookers are daunted, then some new quack will arise to fool them again, with some new and worse scheme of super-Prohibition. It is their destiny to wobble thus endlessly between quack and quack. One pulls them by the right arm and one by the left arm. A third is at their coat-tail pockets, and a fourth beckons them over the hill.

The rest of us are less tender-minded, and, in consequence, much happier. We observe quite clearly that the world, as it stands, is anything but perfect — that injustice exists, and turmoil, and tragedy, and bitter suffering of ten thousand kinds — that human life at its best, is anything but a grand, sweet song. But instead of ranting absurdly against the fact, or weeping over it maudlinly, or trying to remedy it with inadequate means, we simply put the thought of it out of our minds, just as a wise man puts away the thought that alcohol is probably bad for his liver, or that his wife is a shade too fat. Instead of mulling over it and suffering from it, we seek contentment by pursuing the delights that are so strangely mixed with the horrors — by seeking out the soft spots and endeavoring to avoid the hard spots. Such is the intelligent habit of practical and sinful men, and under it lies a sound philosophy. After all, the world is not our handiwork, and we are not responsible for what goes on in it, save within very narrow limits. Going outside them with our protests and advice tends to become contumacy to the celestial hierarchy. Do the poor suffer in the midst of plenty? Then let us thank God politely that we are not that poor. Are rogues in offices? Well, go call a policeman, thus setting rogue upon rogue. Are taxes onerous, wasteful, unjust? Then let us dodge as large a part of them as we can. Are whole regiments and army corps of our fellow creatures doomed to hell? Then let them complain to the archangels, and, if the archangels are too busy to hear them, to the nearest archbishop.

QotD: Teddy Roosevelt and the rise of the Progressives

When, after a generation of that sort of compromising, the so-called Progressive party was organized and he [Theodore Roosevelt] seized the leadership of it from the Westerners who had founded it, he performed a feat of wholesale englutination that must forever hold a high place upon the roll of political prodigies. That is to say, he swallowed at one gigantic gulp, and out of the same herculean jug, the most amazing mixture of social, political and economic perunas ever got down by one hero, however valiant, however athirst — a cocktail made up of all the elixirs hawked among the boobery in his time, from woman suffrage to the direct primary, and from the initiative and referendum to the short ballot, and from prohibition to public ownership, and from trust-busting to the recall of judges.

This homeric achievement made him the head of the most tatterdemalion party ever seen in American politics — a party composed of such incompatible ingredients and hung together so loosely that it began to disintegrate the moment it was born. In part it was made up of mere disordered enthusiasts — believers in anything and everything, pathetic victims of the credulity complex, habitual followers of jitney messiahs, incurable hopers and snufflers. But in part it was also made up of rice converts like Roosevelt himself — men eager for office, disappointed by the old parties, and now quite willing to accept any aid that half-idiot doctrinaires could give them. I have no doubt that Roosevelt himself, carried away by the emotional storms of the moment and especially by the quasi-religious monkey-shines that marked the first Progressive convention, gradually convinced himself that at least some of the doctrinaires, in the midst of all their imbecility, yet preached a few ideas that were workable, and perhaps even sound. But at bottom he was against them, and not only in the matter of their specific sure cures, but also in the larger matter of their childish faith in the wisdom and virtue of the plain people. Roosevelt, for all his fluent mastery of democratic counter-words, democratic gestures and all the rest of the armamentarium of the mob-master, had no such faith in his heart of hearts. He didn’t believe in democracy; he believed simply in government. His remedy for all the great pangs and longings of existence was not a dispersion of authority, but a hard concentration of authority. He was not in favor of unlimited experiment; he was in favor of a rigid control from above, a despotism of inspired prophets and policemen. He was not for democracy as his followers understood democracy, and as it actually is and must be; he was for a paternalism of the true Bismarckian pattern, almost of the Napoleonic or Ludendorffian pattern — a paternalism concerning itself with all things, from the regulation of coal-mining and meat-packing to the regulation of spelling and marital rights. His instincts were always those of the property-owning Tory, not those of the romantic Liberal. All the fundamental objects of Liberalism — free speech, unhampered enterprise, the least possible governmental interference — were abhorrent to him. Even when, for campaign purposes, he came to terms with the Liberals his thoughts always ranged far afield. When he tackled the trusts the thing that he had in his mind’s eye was not the restoration of competition but the subordination of all private trusts to one great national trust, with himself at its head. And when he attacked the courts it was not because they put their own prejudice before the law but because they refused to put his prejudices before the law.

In all his career no one ever heard him make an argument for the rights of the citizen; his eloquence was always expended in expounding the duties of the citizen. I have before me a speech in which he pleaded for “a spirit of kindly justice toward every man and woman,” but that seems to be as far as he ever got in that direction — and it was the gratuitous justice of the absolute monarch that he apparently had in mind, not the autonomous and inalienable justice of a free society. The duties of the citizen, as he understood them, related not only to acts, but also to thoughts. There was, to his mind, a simple body of primary doctrine, and dissent from it was the foulest of crimes. No man could have been more bitter against opponents, or more unfair to them, or more ungenerous.

They are men who, at some time or other, have compromised with their honour, either by swallowing their convictions or by whooping for what they believe to be untrue.

The art of politics, under democracy, is simply the art of ringing it. Two branches reveal themselves. There is the art of the demagogue, and there is the art of what may be called, by a shot-gun marriage of Latin and Greek, the demaslave. They are complementary, and both of them are degrading to their practitioners. The demagogue is one who preaches doctrines he knows to be untrue to men he knows to be idiots. The demaslave is one who listens to what these idiots have to say and then pretends that he believes it himself. Every man who seeks elective office under democracy has to be either the one thing or the other, and most men have to be both. The whole process is one of false pretences and ignoble concealments.

QotD: Political morality

There is in him, in his professional aspect, no shadow of principle or honour. It is moral by his code to get into office by false pretences, as the late Dr. [Woodrow] Wilson did in 1916. It is moral to change convictions overnight, as multitudes of American politicians did when the Prohibition avalanche came down upon them. Anything is moral that furthers the main concern of his soul, which is to keep a place at the public trough. That place is one of public honour, and public honour is the thing that caresses him and makes him happy. It is also one of power, and power is the commodity that he has for sale. I speak here, of course, of the democratic politician in his role of statesman – that is, in his best and noblest aspect.

It is my conviction that no normal man ever fell in love, within the ordinary meaning of the word, after the age of thirty. He may, at forty, pursue the female of his species with great assiduity, and he may, at fifty, sixty or even seventy, “woo” and marry a more or less fair one in due form of law, but the impulse that moves him in these follies at such ages is never the complex of outlandish illusions and hallucinations that poets describe as love. This complex is quite natural to all males between adolescence and the age of, say, twenty-five, when the kidneys begin to disintegrate. For a youth to reach twenty-one without having fallen in love in an abject and preposterous manner would be for doubts to be raised as to his normalcy. But if he does it after his wisdom teeth are cut, it is no more than a sign that they have been cut in vain — that he is still in his teens, whatever his biological and legal age. Love, so-called, is based upon a view of women that is impossible to any man who has any experience of them. Such a man may, to the end of his life, enjoy the charm of their society, and even respect them and admire them, but, however much he respects and admires them, he nevertheless sees them more or less clearly, and seeing them clearly is fatal to true romance. Find a man of forty-five who heaves and moans over a woman, however amiable and lovely, in the manner of a poet and you will behold either a man who ceased to develop intellectually at twenty-four or thereabout, or a fraud who has his eye on the lands, tenements and hereditaments of the lady’s deceased first husband. Or upon her talents as nurse, or cook, amanuesis and audience. This, no doubt, is what George Bernard Shaw meant when he said that every man over forty is a scoundrel.

QotD: “Intelligent Design” and the paradox of the human body

The human body, very cunningly designed in some details, is cruelly and senselessly bungled in other details, and every reflective first-year medical student must notice a hundred ways to improve it. How are we to reconcile this mixture of finesse and blundering with the concept of a single omnipotent Designer, to whom all problems are equally easy? If He could contrive so efficient and durable a machine as the human hand, then how did He come to make such botches as the tonsils, the gallbladder, the ovaries and the prostate gland? If He could perfect the elbow and the ear, then why did He boggle the teeth?

Having never encountered a satisfactory — or even a remotely plausible — answer to such questions, I have had to go to the trouble of devising one myself. It is, at all events, quite simple, and in strict accord with all the known facts. In brief, it is this: that the theory that the universe is run by a single God must be abandoned, and that in place of it we must set up the theory that it is actually run by a board of gods, all of equal puissance and authority. Once this concept is grasped the difficulties that have vexed theologians vanish, and human experience instantly lights up the whole dark scene. We observe in everyday life what happens when authority is divided, and great decisions are reached by consultation and compromise. We know that the effects at times, particularly when one of the consultants runs away with the others, are very good, but we also know that they are usually extremely bad. Such a mixture, precisely, is on display in the cosmos. It presents a series of brilliant successes in the midst of an infinity of failures.

I contend that my theory is the only one ever put forward that completely accounts for the clinical picture. Every other theory, facing such facts as sin, disease and disaster, is forced to admit the supposition that Omnipotence, after all, may not be omnipotent — a plain absurdity. I need toy with no such blasphemous nonsense. I may assume that every god belonging to the council which rules the universe is infinitely wise and infinitely powerful, and yet not evade the plain fact that most of the acts of that council are ignorant and foolish. In truth, my assumption that a council exists is tantamount to an a priori assumption that its acts are ignorant and foolish, for no act of any conceivable council can be otherwise. Is the human hand perfect, or, at all events, practical and praiseworthy? Then I account for it on the ground that it was designed by some single member of the council — that the business was turned over to him by inadvertence or as a result of an irreconcilable difference of opinion among the others. Had more than one member participated actively in its design it would have been measurably less meritorious than it is, for the sketch offered by the original designer would have been forced to run the gauntlet of criticisms and suggestions from all the other councilors, and human experience teaches us that most of these criticisms and suggestions would have been inferior to the original idea — that many of them, in fact, would have had nothing in them save a petty desire to maul and spoil the original idea.

Terry Teachout on H.L. Mencken’s Days Trilogy

To clarify, Terry Teachout is talking about a new omnibus edition of H.L. Mencken’s Happy Days, Newspaper Days, and Heathen Days (which I’ll certainly be adding to my various bookstore wish lists):

It happened that I hadn’t looked at any of the Days books since The Skeptic, my Mencken biography, was published in 2002. Nor had I looked at The Skeptic since I last wrote about Mencken. That was four years ago, in a New Criterion essay about the Library of America’s two-volume collection of his Prejudices essays in which I suggested that

    Mencken might possibly be a young person’s writer, one who excites the unfinished mind but has less to offer those who have seen more of life. Certainly those who look to literature for a portrait of the human animal that is rich in chiaroscuro will not find it in the Prejudices … If a great essayist is one who succeeds in getting his personality onto the page, then H.L. Mencken qualifies in spades. The problem is that his personality grows more predictable with closer acquaintance, just as the tricks of his prose style grow more familiar. Like most journalists, he is best consumed not in the bulk of a twelve-hundred-page boxed set but in small and carefully chosen doses.

Hence it was a very pleasant surprise to return to the Days books after a long absence and find my original judgment on them to be confirmed anew. I described Happy Days as “one of [Mencken]’s most completely realized achievements … a masterpiece of pure style” in The Skeptic, and went on to say that Newspaper Days was “at least as good … It, too, is a not-so-minor masterpiece of affectionate reminiscence, one that in a better-regulated world would be recognized as a modern classic.”

QotD: The nature of liberty

So with the Bill of Rights. As adopted by the Fathers of the Republic, it was gross, crude, inelastic, a bit fanciful and transcendental. It specified the rights of a citizen, but it said nothing whatever about his duties. Since then, by the orderly processes of legislative science and by the even more subtle and beautiful devices of juridic art, it has been kneaded and mellowed into a far greater pliability and reasonableness. On the one hand, the citizen still retains the great privilege of membership in the most superb free nation ever witnessed on this earth. On the other hand, as a result of countless shrewd enactments and sagacious decisions, his natural lusts and appetites are held in laudable check, and he is thus kept in order and decorum. No artificial impediment stands in the way of his highest aspiration. He may become anything, including even a policeman. But once a policeman, he is protected by the legislative and judicial arms in the peculiar rights and prerogatives that go with his high office, including especially the right to jug the laity at his will, to sweat and mug them, to subject them to the third degree, and to subdue their resistance by beating out their brains. Those who are unaware of this are simply ignorant of the basic principles of American jurisprudence, as they have been exposed times without number by the courts of first instance and ratified in lofty terms by the Supreme Court of the United States. The one aim of the controlling decisions, magnificently attained, is to safeguard public order and the public security, and to substitute a judicial process for the inchoate and dangerous interaction of discordant egos.

Thus the law, statute, common and case, protects the free American against injustice. It is ignorance of that subtle and perfect process and not any special love of liberty per se that causes radicals of anti-American kidney to rage every time an officer of the gendarmerie, in the simple execution of his duty, knocks a citizen in the head. The gendarme plainly has an inherent and inalienable right to knock him in the head: it is an essential part of his general prerogative as a sworn officer of the public peace and a representative of the sovereign power of the state. He may, true enough, exercise that prerogative in a manner liable to challenge on the ground that it is imprudent and lacking in sound judgment. On such questions reasonable men may differ. But it must be obvious that the sane and decorous way to settle differences of opinion of that sort is not by public outcry and florid appeals to sentimentality, not by ill-disguised playing to class consciousness and anti-social prejudice, but by an orderly resort to the checks and remedies superimposed upon the Bill of Rights by the calm deliberation and austere logic of the courts of equity.

The law protects the citizen. But to get its protection he must show due respect for its wise and delicate processes.
