Conservative arguments for legalization of marijuana
Frances Woolley at the Worthwhile Canadian Initiative blog:
Milton Friedman — Nobel Laureate in Economics and adviser to Ronald Reagan — supported legalizing and taxing marijuana. Stephen Easton’s classic paper advocating marijuana legalization was published by the Fraser Institute. Why do so many right-leaning economists favour marijuana legalization?
Conservative economists typically believe that a person is a best judge of what is in his or her own interests. From this premise it follows that the government should not try to constrain or influence people’s behaviour. Yes, marijuana use has well-documented negative side effects, from memory loss to male breast growth. Yet if fully informed individuals decide that these personal costs are worth accepting for the benefits that marijuana use brings, the government should respect that choice. As Willie Nelson says “I smoke pot and it is none of the government’s business.”

Another reason for conservatives to favour legalization and taxation of marijuana is that they do not like paying taxes. Criminalization costs. According to a 2005 US study, legalization would save state and local governments $5.3 billion annually in reduced enforcement costs, while the federal government would gain another $2.4 billion federally. Locking up people for possession of a small amount of marijuana is a waste of resources, and good fiscal conservatives deplore waste.Taxing marijuana would be a money-maker: $6.2 billion annually, if marijuana were taxed at rates similar to those on alcohol and tobacco, according to this same 2005 report.Those revenues could be used to reduce deficits, or fund reductions in the taxes paid by conservative economists.
Conservatives have lots of good reasons to favour legalization. The people who should be fighting legalization are the small scale growers: little family-run organic pot farms wouldn’t stand a chance against industrial scale agri-business.

The War on Drugs: “For every complex problem, there is an answer that is clear, simple and wrong”
The Wall Street Journal looks at the drug war and considers alternatives:
Our current drug policies do far more harm than they need to do and far less good than they might, largely because they ignore some basic facts. Treating all “drug abusers” as a single group flies in the face of what is known as Pareto’s Law: that for any given activity, 20% of the participants typically account for 80% of the action.
Most users of addictive drugs are not addicts, but a few consume very heavily, and they account for most of the traffic and revenue and most of the drug-related violence and other collateral social damage. If subjected to the right kinds of pressure, however, even most heavy users can and do stop using drugs.
Frustration with the drug-policy status quo — the horrific levels of trafficking-related violence in Mexico and Central America and the fiscal, personal and social costs of imprisoning half a million drug dealers in the U.S. — has led to calls for some form of legalization. Just last week, at the Summit of the Americas in Cartagena, President Barack Obama got an earful from his Latin American counterparts about the need to reverse current U.S. drug policy.
In brief, American (and to a lesser extent, Canadian) drug policies follow this pattern: 1) identify a problem, 2) pass laws against it, 3) discover that the laws haven’t solved the problem, 4) double-down and ratchet up enforcement and penalties. In other words, if it’s not working, then derp it again.

Another Conservative comes around on marijuana legalization
This time, it’s National Post columnist Barbara Kay accepting the arguments on legalization:
Tobacco is harmful in any amount and it remains perfectly legal. Alcohol, while benign in reasonable quantities, is a gateway to alcoholism — the most intractable and damaging of addictions — which causes far more domestic and social misery than marijuana possibly could. And finally, there comes a certain tipping point when resisting the common will for no easily defined reason stops making social or economic sense.
Two thirds of Canadians want marijuana to be decriminalized. It seems clear to me that sooner or later marijuana is going to join alcohol and tobacco as a substance that the government recognizes cannot be eradicated.
Unless the moral argument is too powerful to override — in this case it isn’t — economic realities can’t be ignored. The street value of the cannabis industry in British Columbia is worth an estimated $30-billion a year; it would be worth double or triple that amount if it could legally attract tourists from the U.S. and other countries. Enforcement of our present laws is said to cost $1-billion a year; that money could be put to better use by rehabilitating hard drug addicts. The federal government brings in about $5-billion annually in tobacco taxes; legalizing marijuana would bring in at least a billion or two more.
However, she’s still a Conservative (as the tax angle above clearly shows):
I’d like to see marijuana legalized, but highly regulated. The government should oversee its growth, its potency and its distribution. It should be heavily taxed, as all recreational substances that can be abused are. But I’m not naive. Because it wouldn’t be legally available to minors, and because the strength would be too muted for many potheads, a black market in more potent stuff would spring up immediately. Criminals will focus their efforts on marketing stronger, illegal marijuana to minors. And we shouldn’t be surprised if our First Nations suddenly discover that growing and selling pot are ancient traditions in their culture that exempt them from paying sales taxes.
Legalization will no doubt come with its own set of problems. Commercialization and widespread marketing will bring in masses of new users. And, as I’ve argued before, for accountability and liability purposes, legalization will embroil government, insurance companies, schools and the medicare system in such a tortuous maze of regulatory and enforcement interference with their privacy, that potheads — and the libertarians who see legalization as a liberating panacea — will yearn for the paradoxical simplicity of illegal, but unencumbered access.

Stephen Harper admits the current drug war approach is “not working”
Okay, pretty pedestrian stuff for most Canadians, but an amazing admission for one of Canada’s foremost and outspoken drug warriors to make:
Harper met Canadian journalists and readily admitted differences over the exclusion of Cuba from the Latin summit. He admitted, too, to a disagreement over British rule in the Falkland Islands.
But he was not ready to agree that the division over drug policy is so clear-cut. Rather, he insisted that there is much agreement. Then came the most interesting quote of the day.
“What I think everybody believes,” Harper said, “is that the current approach is not working. But it is not clear what we should do.”
This would be intriguing from any prime minister. From Stephen Harper, whose government’s crime bill ratchets up the penalties for drug possession, it was startling.
But don’t worry, Conservative hard-liners: after that brief slip into honest talk about the ongoing failure of drug prohibition, he quickly rallied and got back to the standard drug warrior talking points:
Lest anyone think he’d undergone a conversion in Cartagena, Harper quickly added the other side of the story.
Drugs, he said, “are illegal because they quickly and totally — with many of the drugs — destroy people’s lives.”
Update: Chris Selley reads the tea leaves and thinks there’s a hint in Harper’s words that may indicate a slight improvement:
So, there’s the same old lunacy. Ending alcohol prohibition was a pretty “simple answer,” wasn’t it? One doesn’t hear many regrets about it nowadays. It is amazing that it still needs to be said, but one more time: Prohibition ensures the overall supply of any given drug will be far more dangerous, if not more addictive, than it would be otherwise. Criminals have only made as much money trafficking drugs, only killed as many scores of thousands of people as they have, because those drugs are illegal. And in light of this, cracking down on otherwise law-abiding people for growing and distributing small amounts of marijuana is patently insane.
Still, if we parse Mr. Harper’s words closely — perhaps too closely — we find him arguing that “many” drugs “destroy people’s lives,” which implies that some don’t. If the “current approach is not working,” as Mr. Harper says, and if “there is a willingness” to consider other approaches … well, what else can we possibly be talking about except, at the very least, lightening up on pot?
Most likely, of course, this was just situational rhetoric. If Mr. Harper was going to go temporarily squishy on drugs, it would be among presidents and prime ministers whose constituents are slaughtered to feed Mr. Harper’s constituents’ habits. Central and South American leaders grow weary of this, as you might imagine.

A “routine” traffic stop in Collinsville, Illinois
Radley Balko tells the full story of a traffic stop in Illinois that demonstrates how eager some police departments are to use “asset forfeiture” to get their hands on the property of innocent people:
Last December, filmmaker Terrance Huff and his friend Jon Seaton were returning to Ohio after attending a “Star Trek” convention in St. Louis. As they passed through a small town in Illinois, a police officer, Michael Reichert, pulled Huff’s red PT Cruiser over to the side of the road, allegedly for an unsafe lane change. Over the next hour, Reichert interrogated the two men, employing a variety of police tactics civil rights attorneys say were aimed at tricking them into giving up their Fourth Amendment rights. Reichert conducted a sweep of Huff’s car with a K-9 dog, then searched Huff’s car by hand. Ultimately, he sent Huff and Seaton on their way with a warning.
Earlier this month, Huff posted to YouTube audio and video footage of the stop taken from Reichert’s dashboard camera. No shots were fired in the incident. No one was beaten, arrested or even handcuffed. Reichert found no measurable amount of contraband in Huff’s car. But Huff’s 17-and-a-half minute video raises important questions about law enforcement and the criminal justice system, including the Fourth and Fifth Amendments, the drug war, profiling and why it’s so difficult to take problematic cops out of the police force.

“When we saw the Huff video in our office, we just laughed,” Rekowski says. “Not because it wasn’t outrageous. But because it’s the kind of thing we see all the time. The stop for a so-called ‘inappropriate lane change,’ the games they play in the questioning, the claims about nervousness or inappropriate behavior that can’t really be contradicted. It’s all routine.”
According to Koester, the defense attorney in private practice, “The dog alert that happens off-camera isn’t unusual either. You see that all the time.”
Koester and Rekowski say the Huff stop has all the markings of a forfeiture fishing expedition. “You see where he asks if [Huff] is carrying large amounts of U.S. currency,” Rekowski says. “It’s pretty clear what they’re after. These kinds of cases put my kids through college.” He laughs, then adds, “I’m only half joking.”

In a twist that will delight conspiracy theorists everywhere, it really was a CIA plot:
In 1951, a quiet, picturesque village in southern France was suddenly and mysteriously struck down with mass insanity and hallucinations. At least five people died, dozens were interned in asylums and hundreds afflicted.
For decades it was assumed that the local bread had been unwittingly poisoned with a psychedelic mould. Now, however, an American investigative journalist has uncovered evidence suggesting the CIA peppered local food with the hallucinogenic drug LSD as part of a mind control experiment at the height of the Cold War.
The mystery of Le Pain Maudit (Cursed Bread) still haunts the inhabitants of Pont-Saint-Esprit, in the Gard, southeast France.

Britain’s stealth decriminalization of marijuana
An interesting post at The Economist on the recent changes to law and police practices in Britain in regard to cannabis cultivation and consumption:
Small growers are squeezing out both importers and the well-connected, often Vietnamese, gangs that once dominated domestic production. The big cannabis factories set up by the latter, with their telltale heat hazes, are fairly easy to spot. Smaller operations are often uncovered only when the electric lights start fires, or when local teenagers mount a burglary.
The police and the courts can neither keep up with the surge in small-scale production, nor are they desperately keen to do so. Last month the government published new sentencing guidelines that advised judges to treat small cultivators less strictly. Attitudes to smokers are softening, too. The reclassification of cannabis in 2009, from class C to the more stringent class B, was oddly accompanied by a more liberal approach to policing consumption. Users caught on the street are rarely arrested; rather, they are issued “cannabis cautions” (a reprimand which doesn’t appear on a criminal record) or fined.

Strangely, this lackadaisical approach is not encouraging people to take up the reefer habit. According to the European Monitoring Centre for Drugs and Drug Addiction, the proportion of people who admit to having used cannabis in Britain has fallen more quickly than in any other European country over the past few years. Just 6.8% of adults told another survey that they used cannabis in 2010, down from 10.9% eight years earlier. The herb is now ubiquitous and effectively tolerated — and, perhaps as a result, not all that alluring.

NY Police domestic spy operation in Muslim neighbourhoods gets little press attention
Natalie Rothschild on the rather disturbing use of NYPD resources to conduct surveillance operations in Muslim areas of New York City and New Jersey:
It has emerged that the White House has funded the New York Police Department’s surveillance of entire Muslim neighbourhoods with money earmarked for fighting drug crime. The revelations were detailed in reports by the Associated Press this week. In response, senior law enforcement officials and politicians have been either unapologetic or silent. Most tellingly, the Obama administration, which has championed Muslim outreach and has said law enforcement should not put entire communities under suspicion, said on Monday that it has no opinion on the matter.
Since the 9/11 attacks, the Bush and Obama administrations have provided $135million to the New York and New Jersey region through the High Intensity Drug Trafficking Area programme (HIDTA). It’s unclear exactly how much of that money was spent on surveillance of Muslims because the programme has little oversight. But the AP discovered that the White House money has paid for cars that plainclothes NYPD officers used to conduct surveillance of Muslim neighbourhoods in New York and New Jersey, and for computers that stored information about Muslim college students, mosque sermons and social events. It also helps pay rent for the NYPD’s intelligence unit.
This is, effectively, a spying programme used to monitor American Muslims as they shop, work, socialise, pray and study. Police have photographed and mapped mosques and recorded license plates of worshippers. They have compiled lists of Muslims who took new, Americanised names, eavesdropped on conversations inside businesses owned or frequented by Muslims, infiltrated Muslim student groups and monitored websites of universities across north-east US. In the name of counterterrorism, Muslim American citizens have been catalogued, their private conversations and everyday activities recorded and stored in databases.

On Monday, White House spokesman Jay Carney said the administration has no opinion on how the HIDTA grant money was spent and that the White House has no authority to direct, manage or supervise any law-enforcement operations. If the administration truly has no power to influence a NYPD programme used for intrusive monitoring of scores of American citizens, then that would indicate great political impotence. After all, both in the domestic and international arenas, the Obama administration has warned against demonising and singling out Muslims in America and turned Muslim outreach into a priority. Well, it is hard to think of any starker way of ‘singling out’ a group than by stalking anyone who looks or sounds like they belong to it.

“The Harper crime policy is less than the sum of its parts”
It’s odd to find myself on the same side of a debate as Roy McMurtry, but he and his co-authors Edward Greenspan and Anthony Doob are much more right than the government in this:
The Harper crime policy is less than the sum of its parts because it does not add up to a crime policy that addresses, or even acknowledges, these basic facts. It squanders resources that could be used to reduce crime. Making it more difficult for people to get out from under the shadow of their much earlier offences (through a pardon or “record suspension”) makes it harder for millions of Canadians with criminal records to reintegrate into society. Adding mandatory minimum penalties will do nothing to deter offenders, who, the data demonstrate, do not expect to get caught.
But the Harper crime policy is more than the sum of its parts because it tells us that the government is committed to ignoring evidence about crime, and does not care about whether our criminal-justice system is just and humane.
The student who grows six marijuana plants in her rented apartment to share with friends will soon face a mandatory minimum sentence of nine months in prison. Meanwhile, assaults have no mandatory minimum sentences. The law says that trial judges are required to impose sentences proportional to their seriousness and the offender’s responsibility for the offence. Is someone who grows six marijuana plants much more dangerous than someone who grows five (for which there is no minimum sentence)? Or who commits an assault? The Harper Tories seemingly think so.
Update: Of course, Stephen Harper rhetorically cast the libertarians out of the Conservative party years ago. The current attempts to provide the police with powers even they have said they don’t need merely provide extra proof. Chris Selley summarizes a National Post editorial on the subject:
The National Post‘s editorialists do not understand how a government that considers the long-gun registry (and, we’d add, the mandatory long-form census) an unconscionable invasion of Canadians’ privacy and a waste of their money can possibly get behind legislation that would “give the government unprecedented access to Canadians’ online activities, by allowing police to collect the personal information of Internet users … without having to go through the cumbersome process of obtaining a warrant beforehand.” We share this frustration. But Public Safety Minister Vic Toews made it quite clear what he thinks of such complaints yesterday, when he said Canadians “can either stand with us or with the child pornographers.” In other words: “Attention, libertarian wing of the Conservative Party of Canada. We think you are immoral, and no longer desire your votes.”

Richard Branson: End the war on drugs
In advance of appearing before the Home Affairs Select Committee’s inquiry into drug policy, Richard Branson expresses his anti-prohibition views in the Telegraph:
Just as prohibition of alcohol failed in the United States in the 1920s, the war on drugs has failed globally. Over the past 50 years, more than $1 trillion has been spent fighting this battle, and all we have to show for it is increased drug use, overflowing jails, billions of pounds and dollars of taxpayers’ money wasted, and thriving crime syndicates. It is time for a new approach.
Too many of our leaders worldwide are ignoring policy reforms that could rapidly reduce violence and organised crime, cut down on theft, improve public health and reduce the use of illicit drugs. They are failing to act because the reforms that are needed centre on decriminalising drug use and treating it as a health problem. They are scared to take a stand that might seem “soft”.
But exploring ways to decriminalise drugs is anything but soft. It would free up crime-fighting resources to go after violent organised crime, and get more people the help they need to get off drugs. It’s time to get tough on misguided policies and end the war on drugs.

Drugs are dangerous and ruin lives. They need to be regulated. But we should work to reduce the crime, health and social problems associated with drug markets in whatever way is most effective. Broad criminalisation should end; new policy options should be explored and evaluated; drug users in need should get treatment; young people should be dissuaded from drug use via education; and violent criminals should be the target of law enforcement. We should stop ineffective initiatives like arresting and punishing citizens who have addiction problems.
The next step is simple: countries should be encouraged to experiment with new policies. We have models to follow. In Switzerland, the authorities employed a host of harm-reduction therapies, and successfully disrupted the criminal drug market. In Portugal, decriminalisation for users of all drugs 10 years ago led to a significant reduction in heroin use and decreased levels of property crime, HIV infection and violence. Replacing incarceration with therapy also helped create safer communities and saved the country money — since prison is far more expensive than treatment. Following examples such as these and embracing a regulated drugs market that is tightly controlled and complemented by treatment — not incarceration — for those with drug problems will cost taxpayers a lot less.
