Good government is a constable — it keeps the peace and protects property. Parasitic government — which is, sad to say, practically the only form known in the modern world — is at its best a middleman that takes a cut of every transaction by positioning itself as a nuisance separating you from your goals. At its worst, it is functionally identical to a goon running a protection racket.

The desire to be left alone is a powerful one, and an American one. It is not, contrary to the rhetoric proffered by the off-brand Cherokee princess currently representing the masochistic masses of Massachusetts in the Senate, an anti-social sentiment. It is not that we necessarily desire to be left alone full stop — it is that we desire to be left alone by people who intend to forcibly seize our assets for their own use. You need not be a radical to desire to live in your own home, to drive your own car, and to perform your own work without having to beg the permission of a politician — and pay them 40 percent for the privilege.
Principles are dangerous things — whiskey is for drinking, water and principles are for fighting over. The anti-ideological current in conservative thinking appreciates this: If we all seek complete and comprehensive satisfaction of our principles, then there will never be peace. This is why scale matters and why priorities matter. In a world in which the public sector consumes 5 percent of my income and uses it for such legitimate public goods as law enforcement and border security, I do not much care whether the tax system is fair or just on a theoretical level; and while I may resent it as a matter of principle, the cost of my consent is relatively low, and I have other things to think about. But in a world in which the parasites take half, and use it mainly to buy political support from an increasingly ovine and dependent electorate, then I care intensely.

Modern photography … can you believe your lyin’ eyes?
Michelle Orange on the ways that photography can mislead and even change reality:
It may be that some of the great philosophical work of our time is taking place, hidden and unheralded, in the field of image forensics. Where but under the scrutiny of digital experts who draw a line separating false representations of the world from truthful ones are contemporary questions of perception and reality brought so keenly to bear? Who but these detectives of the real pursue as explicitly — as intricately — our crime wave of the fake, the contrived, the uncanny, the exponential image? With exquisite, singular focus, photo forensics engages the conundrum that photographic technology has tilted toward, steadily but ever more frankly, since its inception over 150 years ago: Does reality have a tipping point?
Dangling from the cliff edge of that question is the World Press Photo competition. In recent years the annual competition, which recognizes images submitted by photojournalists working across the globe, has dissolved into chaos, recrimination and a round of post-mortem soul-searching. Earlier this year, the WPP was forced to disqualify 22 percent of the competition’s finalists after forensics experts determined that certain images had been altered or manipulated beyond the currently accepted industry standard. This almost triples the number of disqualifications from a year earlier, suggesting a certain forward momentum, a trend larger and more fearsome than any set of standards.
Swedish photographer Paul Hansen won the 2013 World Press Photo competition with an image of a Gaza City funeral procession, led through an alley by men bearing the shrouded bodies of two children killed in an Israeli airstrike. Separate from the horror it depicts, with its fish-eye depth of field, stark figuration and stony matte light, the photo meets the eye as unreal. Complaints in this vein led to an investigation of the image, specifically its manipulation of tone — a quality central to photography’s evolving grammar of realism. Somehow both a beautifying tool and, in the right hands, possessed of the very texture of reality (as every Instagram filter maven knows), tone is transformative. For that reason, “excessive toning” is against WPP rules; Hansen said he adjusted tone only to balance uneven light, “in effect to recreate what the eye sees.” Ultimately, Hansen retained his prize: the judges stood behind what they saw, though it would appear their eyes prefer altered images a good portion of the time.
The media and free speech coverage
At Popehat, Ken White explains what to look for in how the media subtly (or not-so-subtly) introduce pro-censorship memes when it covers free speech issues:
American journalists and pundits rely upon vigorous free speech, but are not reliable supporters of it. They both instruct and reflect their fickle audience.
It’s easy to spot overt calls for censorship from the commentariat. Those have become more common in the wake of both tumultuous events (like the violence questionably attributed to the “Innocence of Muslims” video, or Pamela Geller’s “Draw Muhammad” contest) and mundane ones (like fraternity brothers recorded indulging in racist chants).
But it’s harder to detect the subtle pro-censorship assumptions and rhetorical devices that permeate media coverage of free speech controversies. In discussing our First Amendment rights, the media routinely begs the question — it adopts stock phrases and concepts that presume that censorship is desirable or constitutional, and then tries to pass the result off as neutral analysis. This promotes civic ignorance and empowers deliberate censors.
Fortunately, this ain’t rocket science. Americans can train themselves to detect and question the media’s pro-censorship tropes. I’ve collected some of the most pervasive and familiar ones. This post is designed as a resource, and I’ll add to it as people point out more examples and more tropes.
Price Ceilings: Rent Controls

Rent controls are a type of price ceiling. We’ll use our diagram to show how rent controls create shortages by reducing the supply of apartments available on the market. Rent controls also result in reduced product quality, since they reduce the returns to landlords from renting apartments. Landlords respond by cutting costs or performing less maintenance, leading to lower quality. There are search costs associated with rent controls, and they also lead to a misallocation of resources since apartments are not allocated to renters who value them the most.
The onrushing infantilization of the West
Kit Wilson examines the state of western thought and belief:
Consider the main philosophical movements of the 20th century. The majority followed the fearsome footsteps of Friedrich Nietzsche — the man who killed God and buried good and evil at His side. And though they grappled with his legacy in a variety of ways, they shared, more or less, the same key assumption: that the traditional pursuits of thought — truth, beauty, meaning — were fundamentally misguided. Philosophy, unable to comment on the world, turned instead to — and on — itself. “Having broken its pledge to be at one with reality,” Theodor Adorno wrote, “philosophy is obliged to ruthlessly criticise itself.”
At the same time, positivism — the belief that only empirical or logically deduced data have any real meaning — took hold among many of the West’s intellectual circles. A.J. Ayer and Bertrand Russell declared that, if we were ever to understand ourselves, it would be by scientific means alone. Cultural memory, which could not be reduced to testable propositions, was made entirely superfluous.
Wherever one looked, the West seemed to be in the midst of a curious experiment: can a civilisation survive on nothing but the impulse to debunk its own presuppositions?
Adorno and his co-author Max Horkheimer tried to tackle this question in Dialectic of Enlightenment. A bleak assessment of Western culture, it argued that modernism, nihilism and reductionism were symptoms of the same fundamental malady — the suicide of Enlightenment thinking. Our insatiable appetite for self-criticism, the monstrous alter ego of philosophical scepticism, was finally gnawing at the very foundations on which we stood.
Adorno and Horkheimer thought it unlikely we would survive, and predicted three historical steps that would see us collapse altogether. High culture — including art — would exhaust itself, taking with it any sense of a shared inheritance. Second, we would lapse into infantile solipsism, duped by the immediate gratifications of capitalism — in particular, cinema and popular music. Finally, society — stupefied by such pleasures — would topple at the first serious test of its walls. Adorno and Horkheimer saw a host of surrogate mythologies — most notably, Nazism — poised to flood into the vacuum left behind.
This final point seemed borne out by the events of the 1930s and 1940s. But then, as the war receded into the past, much of the West suddenly found itself reclining into an unprecedented period of peace and prosperity. To the baby boomers, Adorno and Horkheimer’s stuffy pessimism seemed laughably outmoded. And today, we assume — having never known any different — that this good fortune is simply here to stay. At a time of such global instability — with Putin and Islamism openly challenging our values — we urgently need to reconsider our confidence. Were the last 70 years really the final disproof of Adorno and Horkheimer’s pessimism, or did history merely postpone its judgment?
Let us begin with the charge of Western infantilism. Here, at least, Adorno and Horkheimer seem to have been rather prescient. The West is — for all its wealth today — far more childish than even they anticipated. This can be traced — I believe — to the reductionist narratives we adopted as our mantras during the last century.
QotD: Modern urban policing
Let me interject that I hold no brief for the police in America, at least in the cities. They inspire me with a frisson of fear every time I see one, though I break no law. Their manner is more that of masters of the public than of servants of the same; many of them seem to be the kind of people who wanted to be soldiers but couldn’t make the grade because they were not fit enough. They look menacing and seem to shoot to kill on relatively slight pretexts (or perhaps they are just bad shots). I have little doubt that if I were black my less than warm feelings toward them would be a good deal cooler still. Their increasing militarization, on the flimsiest of pretexts, is another reason to mistrust them. Alas, the British police are increasingly modeling themselves on the American, as if they were permanently on riot duty.

Restaurant reviews … with real teeth
In The Guardian, Jay Rayner provides the kind of review that you rarely see in your local newspaper (because it guarantees that the restaurant will never buy advertising from you again):
Cooking a steak well is tricky, because you cannot see inside the meat. It takes experience and knowledge. Cooking chips is easy: use the right potatoes, give them a couple of runs through the hot oil, make sure they’re the right colour, perhaps even taste a couple. The job is done. At Smith & Wollensky, the new London outpost of a well-known small American steakhouse chain, we sent back the chips because they were tepid and under-cooked. They returned to us hot and undercooked. And in that one example of carelessness and lack of attention to detail, you know all you need to.
But I had to sit through the whole damn meal so I don’t see why you shouldn’t, too. This US business has swaggered into London like it thinks it’s the bollocks. The description is almost right, if you remove the definite article before the reference to testicles. It is about as shoddy an operation in separating people from inexcusable amounts of their cash as I have seen in a very long time.

The menu also mentions a list of blackboard specials – T-bones and so on – all of which have run out by 8.20pm. We order the bone-in ribeye. The char is feeble and the overwhelming taste is of salt. Worse is the texture. It’s floppy. Part of this, I think, is a cultural difference; Americans like to celebrate steaks based on tenderness, as if being able to cut a piece of dead animal with a butter knife is an aspiration. I think that if you’re going to eat beef, you want to know it has come from an animal that has moved. This steak slips down like something that has spent its life chained to a radiator in the basement.
The sauces are dire. A béarnaise is an insult to the name, lacking any acidity or the anise burst of tarragon. An au poivre sauce is just a shot of hot demi-glace. A side salad is crisp and well dressed. We take comfort in it. Many other sides are priced for two which is a quick route to higher profit margins and greater food waste. The £9 battered onion rings are good; the £10 truffled mac and cheese is dry and tastes not at all of truffle. Those terrible chips come in the kind of mini-chip-fat-fryer-basket used at chain pubs.
Service is omnipresent. Twice we ask to keep our bread and side plates when they attempt to remove them. When a third waiter lunges in I finally admit defeat. Take them if you’re so bloody desperate. How hard is it to communicate a table’s wishes to the half dozen people working a corner of the floor, especially when a meal is going to cost more than £100 a head?

You could easily respond to this week’s restaurant with furious, spittle- flecked rage. You could rant about the posing-pouch stupidity of the meat – hanging cabinet that greets you as the lift doors open, and the frothing tanks of monstrous live Norwegian king crabs next to it, each 4ft across. You could bang on about the bizarre pricing structure, and the vertiginous nature of those prices; about the rough-hewn communal tables that are so wide you can’t sit opposite your dining companion because you wouldn’t be able to hear each other, and the long benches which make wearing a skirt a dodgy idea unless you’re desperate to flash the rest of the heavily male clientele. You could shake your fists and roll your eyes and still not be done.
I think this would be a mistake. Instead you should accept Beast as the most unintentionally funny restaurant to open in London in a very long time. It’s hilariously silly. The most appropriate response is to point and laugh. I don’t even think I’d advise you not to go. As long as you go with someone else’s money, because God knows you’ll need a lot of it. Got any friends who are, say, international drug barons? Excellent. They may be able to afford dinner. It’s worth going to see what the unmitigated male ego looks like, when expressed as a restaurant.

The corn-fed, dry-aged Nebraskan rib-eye, with a carbon footprint big enough to make a climate-change denier horny, is bloody marvellous: rich, deep, earthy, with that dense tang that comes with proper hanging. And at £100 a kilo it bloody well should be. At that price they should lead the damn animal into the restaurant and install it under the table so it can pleasure me while I eat.
Washington’s streetcars
Warren Meyer isn’t a fan of streetcars in general, but he views the Washington DC streetcar project as being particularly deserving of scorn:
I am increasingly convinced that the appeal of streetcars and light rail has everything to do with class. From any rational perspective, these systems make no sense — they are 10-100x more expensive than buses and lack the flexibility that buses have to adjust to shifting demand patterns over time. A single extra lane of highway adds more capacity than any light rail line.
Streetcar’s single, solitary advantage is that middle and upper class whites who would not be caught dead on a bus seem to be willing to ride streetcars. I don’t know if this is because of some feature of the streetcars (they are shiny and painted pretty) or if it is some sort of self-segregation (the upper classes want to ride on something that is not filled with “riffraff”).
He also points out that even Vox.com can’t make the case for streetcars particularly well:
The arguments are:
- Tourists like them, because you can’t get lost like you can on buses. My response is, “so what.” Unless you are one of a very few unique cities, tourists are a trivial percentage of transit riders anyway. Why build a huge system just to serve out-of-town visitors? I would add that many of these same cities (e.g. Las Vegas) considering streetcars are the same ones banning Uber, which tourists REALLY love.
- Developers like them. Ahh, now we are getting somewhere. So they are corporate welfare? But not so fast, they are not even very good corporate welfare. Because most of the studies they cite are total BS, of the same quality as studies that say sports stadium construction spurs all sorts of business. In fact, most cities have linked huge tax abatement and subsidy programs to their streetcars, such that the development you get with the subsidy and the streetcar is about what you would expect from the subsidies alone. Reminds me of the old joke that mimicked cereal commercials: “As part of a breakfast with juice, toast, and milk, Trix cereal has all the nutrition of juice, toast, and milk.”
- Good for the environment. But even Vox asks, “as compared to what.” Since they are generally an alternative buses, as compared to buses that have little environmental advantage and often are worse (they have a lot more weight to drag around when empty).
- The Obama Administration likes them. LOL, that’s a recommendation? When you read the text, what they actually say is that mayors like the fact that the Obama Administration likes them, for it means the Feds will throw lots of Federal money at these projects to help mayors look good using other peoples’ money.
- Jobs. This is hilarious Keynesianism, trying to make the fact that streetcars are 10-100x more expensive than buses some sort of positive. Because they are more inefficient, they employ more people! One could make the exact same argument for banning mechanical harvesters and going back to scythes. Left unquestioned, as Bastiat would tell us, is how many people that money would have employed if it had not been seized by the government for streetcar use.
- Je ne sais quoi. I kid you not, that is their final argument, that streetcars add that special something to a neighborhood. In my mind, this is Vox’s way of saying the same thing I did the other day — that the streetcar’s appeal is primarily based on class, in that middle and upper class folks don’t want to ride on a bus with the masses. The streetcar feels more upscale than buses. The poor of course, for whom public transit is most vital, don’t want to pay 10 times more for sexiness.
Every argument I have ever been in on streetcars always boils down to something like “well, all the cool kids like them.”

QotD: Lenin’s moment of clarity
There is not very much good to say about the life and career of Vladimir Lenin, but give the pickled old monster this much: He cut through more than two centuries’ worth of bull and straight to the heart of all politics with his simple question: “Who? Whom?” Which is to say: Who acts? Who is acted upon? Even here in the land of the free, meditating upon that question can be an uncomfortable exercise.
The foundation of classical liberalism, and of the American order, is not the rule of law, a written constitution, freedom of speech and worship, one-man/one-vote democracy, or the Christian moral tradition — necessary as those things are. The irreplaceable basis for a prosperous, decent, liberal, stable society is property. Forget Thomas Jefferson’s epicurean flourish — John Locke and the First Continental Congress had it right on the first go-round: “Life, liberty, and property.” Despite the presence of the serial commas in that formulation, these are not really three different things: Perhaps we should render the concept “lifelibertyproperty” the way the physicists write about “spacetime.”

Japan’s cross-dressing WW2 spy in China
In The Diplomat, Stephen Joyce reviews Manchu Princess, Japanese Spy: The Story of Kawashima Yoshiko, the Cross-Dressing Spy Who Commanded Her Own Army, a recent book by Phyllis Birnbaum:
Divisive figures often make the most compelling biographical subjects; and Kawashima Yoshiko is no exception. During her life and in death opinions have varied markedly. Loathed by the Chinese as a traitor, extolled by the Japanese for her talents as a spy, more recently she has even become a heroine to the LGBT community.
In Manchu Princess, Japanese Spy: The Story of Kawashima Yoshiko, the Cross-Dressing Spy Who Commanded Her Own Army, Phyllis Birnbaum provides a measured assessment of the fascinating rise and fall of this erratic, narcissistic, cross-dressing, bisexual princess.
Born in 1907 as Aisin Gioro Xianyu, Kawashima Yoshiko was the 14th daughter of Prince Su of the Qing imperial family. Soon after the establishment of the Republic of China in 1912, she was unwillingly sent to Japan to be adopted by family friend Kawashima Naniwa.
Her formative teenage years were spent in Matsumoto being educated in Japanese language and culture. It was not the happiest of upbringings. An attempted suicide and sexual assault by her new father are noted as potentially life-defining events but are hard to verify. Whatever the root cause of her discontent, in 1925 she shaved her head and started wearing men’s clothes.
In 1927 she married a Mongolian prince in a politically convenient union that quickly failed and Yoshiko soon travelled to China to pursue her dream of a honorable return to power for the Qing dynasty, beginning with Manchuria and Outer Mongolia.
With Japan increasingly active in China she soon found herself a raison d’etre: a spy in the service of the Japanese. Several incidents define her status as a spy; all are shrouded in mystery.

Although it would be hard to argue that she had a major influence over the key events of her time, Kawashima Yoshiko is a superb subject for biography and should interest all lovers of Asian history. And despite living her life in the public and media glare her essential mysteriousness remains—even in death. Did the Chinese Nationalist government execute her (as Kim Bai Fai) in 1948 or, as some would have it, did she escape and live out her last days quiet obscurity? Birnbaum concludes that the latter outcome is questionable, to say the least. Assuming she was indeed executed, her memoirs reveal a wry acceptance of her ultimate fate, despite her life aims lying in tatters.
The sheer wealth of material — autobiographies, Yoshiko’s letters, interviews, press reports, sensationalist magazine articles and official documents — with which to write a biography to some extent serves to cloud rather than illuminate the life of Yoshiko Kawashima. Much like her futile efforts to restore the Qing dynasty in China, any attempt to firmly pin down her real life story and true character seems destined to fail.

Toronto’s Pan Am Games organizers appear to have been living in a cave without an internet connection for the last 15 years:
The organisers of the Pan American Games in Toronto, which start this week, require that people seek formal permission to link to its website at [toronto2015 DOT org].
Under the website’s terms of use, amid piles of incomprehensible legalese seemingly designed to hide from the fact that social media exists, it is decreed that no one is allowed to use one of those hyperlink thingies to connect to the website unless they first get approval. It reads:
Links to this Site are not permitted except with the written consent of TO2015™. If you wish to link to the Site, you must submit a written request to TO2015™ to do so. Requests for written consent can be sent to branduse@toronto2015.org. TO2015™ reserves the right to withhold its consent to link, such right to be exercised in its sole and unfettered discretion.
Eagle-eyed readers will have noticed that the $2bn sports event – effectively a mini-Olympics – also appears to have trademarked the term “TO2015.” Which makes about as much sense.
Incredibly, this is not a misreading of the terms, and it doesn’t appear to have been a mistake either. Instead, it’s about the increasingly insane approach that intellectual property lawyers are taking to sponsors – and non-sponsors – of sporting events.
Alongside such gems as forcing people to put tape over their own computers if a computer company is a sponsor, and stopping people for drinking anything that isn’t a sponsor drink (if there is a drinks sponsor), now it seems the Pan Am Games lawyers have decided they need to prevent the internet from entering the hallowed sponsor world.
Strictly speaking, anyone who links to the website or even anyone who uses the games’ own hashtag of [hashtagTO2015] is violating its terms, and could be sued. Although not a court in the land would actually enforce it.
Notice that, as I live in Canada, I’ve carefully obfuscated the URL and the hashtag so you don’t accidentally click on them and violate their intellectual property right claims or anything. I suspect this will be the only actual coverage of the games I’ll be posting, just to be on the safe side. Discussion of the financial side, or the disruption to normal life in Toronto caused by the games, of course, is still fair game.
Do photographers have any rights left?
I no longer do much in the way of “serious” photography (my digital SLR has been out of service for a couple of years now), but I still occasionally do a bit of cellphone photography when the occasion arises. On the byThom blog, Thom Hogan provides a long (yet not exhaustive) list of things, places, and people who are legally protected from being photographed in various jurisdictions … and it gets worse:
Funny thing is, smartphones are so ubiquitous and so small, many of those bans just aren’t enforceable against them in their natural state (e.g., without selfie stick), especially if they’re used discriminatingly.
I’m all for privacy, but privacy doesn’t exist in public spaces as far as I’m concerned. Indeed, I’d argue that even in private spaces (malls, for example), that if you’re open for and soliciting business to the public, you’re a public space. As for Copyright, placing artwork in open public spaces (e.g. Architecture) probably ought to convey some sort of Fair Use right to the public, though in Europe we’re seeing just the opposite start to happen. FWIW, I no longer visit and thus don’t photograph in two countries because of national laws regarding photography. Be careful what you wish for, Mr. Bureaucracy; laws often have unintended consequences. As in reducing my interest in visiting your country.
About half of this site’s readers actively practice some form of travel photography, either during vacations or while traveling for business. Note how many of the restrictions on photography start to apply against those that are traveling (locally or farther afield). It’s always easy to impose laws on people who don’t vote for you. it’s why rental car and hotel room taxes are so high, after all.
What prompted this article, though, wasn’t any of the latest photography ban talk, though. Here in Pennsylvania we have fairly restrictive regulations on “recording” another person (e.g. conversations, phone calls, meetings, etc.). In some states, it only takes one party to consent for a recording to be legal. Here in Pennsylvania it takes all parties to consent to being recorded.
