All those boats have been burned

Megan McArdle on the problem with emulating the Conquistator model of operational planning and burning your boats:

There’s a legend that after Hernan Cortes and his crew landed on the shores of the New World, Cortes ordered that their boats be burned. The only way they would be able to get back to Spain would be to conquer the land, giving them the resources to build new boats. With necessity at their backs, his band of adventurers managed to conquer all of Mexico.

It’s not clear if this story is actually true, but it’s nonetheless beloved by motivational speakers. The last two weeks of political paralysis have been an excellent illustration of why you shouldn’t model your negotiation strategy on a guy who’s mostly famous for slaughtering strangers.

The state insurance exchanges aren’t working, Obamacare is in jeopardy, and Democrats are casting around for a way to blame this on Republicans. The answer they have settled on: It’s their fault because Republican governors did not set up exchanges.

Think about what they are actually saying: “We passed a law that was so incredibly fragile that it was destined to fail unless all the state governments controlled by the party that opposed this law worked hard to make the system a success.”

And why did they expect this to happen? The answer boils down to this: “After we burn the boats, everyone’s supposed to band together to fight the Aztecs!”

I’ve long criticized the health-care law for being a Rube Goldberg Policy Machine: There are dozens of pieces that all have to work perfectly. If one of them fails, the whole apparatus breaks down and the individual insurance market spirals toward death. That seemed risky to me, especially when the law was passed over fervent opposition — a fervent opposition that was smugly told that “elections have consequences,” without anyone apparently considering that future elections might have different consequences.

But in this view, the Rube Goldberg quality is actually a plus, because after all, if we do something that might break the insurance market unless Republicans enthusiastically cooperate, they’ll have to enthusiastically cooperate.

This is … what’s the technical term? Right, insane.

Start with the fact that the state exchanges — what we would have had if the Republican governors and legislatures had cooperated — aren’t all in such great shape, either. Don’t get me wrong; some of them are doing very well. But some aren’t really working at all, and in others the results are … unclear. And that’s in blue states where the governor and the legislature were hugely enthusiastic about this program and are going all out to make it work. As anyone who has ever implemented a new program (corporate or government) can tell you, one of the biggest hurdles is getting people who don’t care about your program, or who actively oppose it, to make their piece work. Even if they’re trying in good faith, they have neither your enthusiasm nor your deep grasp of the internal logic. In the best-case scenario, it’s not their No. 1 priority; when it competes for resources with stuff they really care about, it tends to get the second-string people and budget. This is one reason that promising pilot projects often fail when they’re rolled out to the larger organization—and one of the most important things that a corporate innovator has to do is to evangelize his program so that other departments get as enthusiastic as he is.

The Obama administration was not in a position to evangelize the president’s health-care program to Republican governors. If the law absolutely required that those governors be as enthusiastic about implementing a state exchange as the folks in the administration, then it was a bad law that should never have been passed, and the Democrats made a grave mistake that could destroy the nation’s insurance market.

After the boat-burning failed the first time, leaving it weeks from its debut without a working computer system, the administration seems to have decided that what was needed was simply a larger bonfire: Launch the nonworking system, because after all, once you’ve gone live, the potential catastrophe would be nearly upon us, which would somehow force those inside and outside the administration to somehow bring order out of the chaos they had created.

But Republicans should make this work! It’s the right thing to do! That is, of course, debatable. But aside from that, this is magical thinking — as magical as the Tea Partiers who responded, when I pointed out that the shutdown was costing them the support they’d need to retake the Senate and the White House and actually get some policy making done, that this was all the fault of the liberal media, which was just repeating administration talking points.

In which Jonah Goldberg compares the Tea Party to Nazis

This week’s Goldberg File email included a brief analysis of Raiders of the Lost Ark and tied it to the last couple of weeks of Washington political theatre:

If the Tea Party isn’t pissing someone off, it’s doing it wrong.

Like the skinny guy everyone in prison is afraid of, much of the Tea Party’s political power is drawn from the perception that it’s just a little crazy. Boehner’s hand has been strengthened over the last few years by his ability to tell Obama, “Hey, look, I’d love to cut a deal with you but you see those guys over my right shoulder? — DON’T LOOK THEM IN THE EYE! They are crazy and if I walk back there with what you’re offering they will rip off my legs and beat me to death with them. And then they will get mean.”

So why did I get crosswise with them this time? Because I didn’t think their strategy would work. But going over all that again feels like airing dirty laundry during Thanksgiving dinner just so you can get grandma riled up about grandpa’s escapades during the war. “You weren’t fighting Communists! You were fighting syphilis! We’re going home!”

Still, like most of my colleagues, I didn’t think the strategy would work. And that was a risk for the Tea Parties themselves. Sometimes to use power means to lose power. Good hostage-takers are always careful to ask for a ransom the victim’s families can afford to pay, otherwise what’s the point?

Indiana Jones and the Tea Party of the Lost Ark

In a recent episode of The Big Bang Theory, Sheldon introduces his girlfriend, Amy, to the Raiders of the Lost Ark, which she’d never seen before. She liked the movie, she explains, despite the big “story problem.” Sheldon is aghast at the suggestion there could be any story problems with the “love child” of Steven Spielberg and George Lucas. “What story problem?” he demands to know. She explains that Indiana Jones is absolutely irrelevant to the story. If he’d never gotten involved, the Nazis would have still found the ark of the covenant, they would have still brought it to that island, and they would have still had their faces melted.

I’d never thought of it that way before, but it’s actually a very close parallel complaint to the one I’ve written about many times. My dad — who loved the movie — always laughed at the idea that the Nazis would be able to use the ark for their dastardly purposes. The idea that God would be like, “Darn, it’s out of my hands. I guess I have no choice but to lend you my awesome powers for your evil deeds,” is pretty ridiculous. They even returned to this idea in the third movie, when the Nazis tried to get their hands on the Holy Grail — because, you know, Jesus would totally say, “Nazis!? Rats. There’s nothing I can do. It’s life everlasting for the SS!”

I’m no theologian, but I just have a hard time believing that’s how God rolls.

Anyway, I bring this up because I think you can say something similar about the last few weeks. There was a whole lot of action, but at the end of the day, things worked out the way they were going to all along. I’m sure there’s a really good extended metaphor in here somewhere. Default was the face-melting ark, but we looked away at the last minute. Or defunding Obamacare was the Holy Grail, or something like that. But I want to get back to why I feel pretty good about how things worked out.

QotD: Progressives and power

Charlie Cooke had a very good column and follow up post this week on progressive disdain for our system of separated powers. What liberals want, according to Charlie, is an “elected king” who can do whatever he wants. I agree with him almost entirely. For instance, he doesn’t say it, but this is exactly what Thomas Friedman wants. It’s what all the pseudo-eggheady-jagoff technocrats always want. The desire to simply impose “optimal policies” heedless of democratic or legal impediments lies behind virtually every technocratic fad of the last couple of centuries. We know what to do, and the problem with democracy is that the rubes won’t let us do it! Stuart Chase, one of the architects of the New Deal (who some say coined the term), openly pleaded for an “economic dictatorship.” After all, he asked, “why should the Russians have all the fun remaking the world?”

But here’s where I disagree a bit with Charlie. The key issue for progressives has never been the form power takes, but power itself. You want my five-second lesson in progressive history? No? Sucks for you, because I’m going to tell you anyway: They always go where the field is open.

That’s it.

When the public was on their side the progressives relied on the public. That’s why we have the direct election of senators. That’s why women got the franchise. Etc. In his early years as an academic Woodrow Wilson wanted Congress to run the country — the way parliament runs England — and relegate the president to a glorified clerk. When the public became unreliable and Congress was no longer a viable vehicle, progressives suddenly fell in love with a Caesarian presidency. Indeed, Wilson himself, the former champion of Congress, became an unapologetic voluptuary of presidential power the moment it suited him — and nary a progressive complained (save poor Randolph Bourne, of course). The progressives rode the presidency like it was a horse they never expected to return to a stable. And when that started to hit the point of diminishing returns, they moved on to the courts (even as they bleated and caterwauled about Nixon’s “abuses” of powers that were created and exploited by Wilson, FDR, and Johnson). After the courts, they relied on the bureaucracy. Like water seeking the shortest path, progressives have always championed the shortest route to social-justice victories.

My point is that I think Charlie is entirely right that progressives want to maximize their power. But the elected king scenario is just one of many they’d be perfectly happy with. If they could have a politburo instead of a unitary executive, they’d probably prefer that. But the point is that the instruments are, uh, instrumental. The core imperative is power. We see this in miniature when liberals don’t control the presidency but do control Congress. Suddenly, it’s vital that the “people’s house” exert its constitutional prerogatives! When the president is a Democrat he needs to rule unimpaired. When he’s a Republican, his dictatorial tendencies must be held in check. When liberals want to reinterpret the Constitution by judicial whim or fiat, it’s proof that the Constitution is living up to its nature as a “living, breathing, document.” When conservatives actually want to amend the Constitution — the only legitimate and constitutional means to change the meaning of the Constitution, I might add — it is a horrible affront to the vision of the Founders!

Once you realize this it helps explain so many of the Left’s hypocrisies and alleged double standards. I say alleged, because they aren’t really double standards. You can only have a double standard when you actually believe something should be a standard. Ultimately, for progressives these procedural debates about how power is used in America are just that: procedural debates. The alleged standards at stake are evanescent and petty — for liberals. The only true standard is whatever advances the progressives’ ball downfield. That is the very heart of “social justice” — doing whatever “good” you can, when you can, however you can. As they say, behind every confessed double standard there is an unconfessed single standard. And for progressives, the single enduring standard is “whatever works for us.”

Why this government shutdown is different from the last 17 shutdowns

Jonah Goldberg on what sets the current US government “shutdown” apart from all the others in recent memory:

Obama has always had a bit of a vindictive streak when it comes to politics. I think it stems from his Manichaean view of America. There are the reasonable people — who agree with him. And there are the bitter clingers who disagree for irrational or extremist ideological reasons.

In his various statements over the last week, he’s insisted that opponents of Obamacare are “ideologues” on an “ideological crusade.” Meanwhile, he cast himself as just a reasonable guy interested in solving America’s problems. I have no issue with him calling Republican opponents “ideologues” — they are — but since when is Obama not an ideologue?

The argument about Obamacare is objectively and irrefutably ideological on both sides — state-provided health care has been an ideological brass ring for the Left for well over a century. But much of the press takes its cues from Democrats and sees this fight — and most other political fights — as a contest pitting the forces of moderation, decency, and rationality against the ranks of the ideologically brainwashed.

What’s unusual is the way Obama sees the government as a tool for his ideological agenda. During the fight over the sequester, Obama ordered the government to make the 2 percent budget cut as painful and scary as possible.

When Republicans vote to fund essential or popular parts of the government, the response from Democrats is, in effect, “How dare they?” Nancy Pelosi calls the tactic “releasing one hostage at a time” — as if negotiators normally refuse to have hostages released unless it’s all at once.

In the 17 previous government shutdowns since 1977, presidents have worked to avoid them or lessen their impact. Obama has made no such effort out of an ideological yearning to punish his enemies, regardless of the collateral damage.

Roll back Obamacare? Not with these tactics

Coyote Blog calls the current approach by the GOP “Republican Fail” and explains why:

Yes, I understand why things are happening as they are. From a re-election strategy, their approach makes total sense. A lot of these House guys come from majority Republic districts where their biggest re-election fear comes from a primary challenge to the right of them. I live in one of these districts, so I see what perhaps coastal media does not. In everyday conversation Republicans are always criticizing their Congressmen for not rolling back Obamacare. Republicans need to be able to say in a primary, “I voted to defund Obamacare”. Otherwise I guarantee every one of them will be facing a primary opponent who will hammer them every day.

But from the perspective of someone who just wants the worst aspects of this thing to go away, this was a terrible approach. Defunding Obamacare entirely was never, ever, ever going to succeed. Obama and Democrats would be happy to have a shutdown last months before they would roll back his one and only signature piece of legislation. They may have caved in the past on other issues but he is not going to cave on this one (and needs to be seen not caving given his recent foreign policy mis-steps that has him perceived as weak even in his own party). And, because all the focus is on Obamacare, we are going to end up with a budget deal that makes no further progress on containing other spending.

Justin Amash on congressional classified briefings

In The Atlantic, Garance Franke-Ruta has transcribed some of Representative Justin Amash’s comments on the ins-and-outs of confidential briefings offered to congressmen:

Amash, who has previously butted heads with Intelligence Committee Chairman Mike Rogers and ranking member Dutch Ruppersberger over access to classified documents, recounted what happened during remarks before libertarian activists attending the Liberty Political Action Conference in Chantilly, Virginia, Thursday night. I quote his anecdote in full here, because it’s interesting to hear what it feels like to be one of the activist congressmen trying to rein in National Security Agency surveillance:

    What you hear from the intelligence committees, from the chairmen of the intelligence committees, is that members can come to classified briefings and they can ask whatever questions they want. But if you’ve actually been to one of these classified briefings — which none of you have, but I have — what you discover is that it’s just a game of 20 questions.

    You ask a question and if you don’t ask it exactly the right way you don’t get the right answer. So if you use the wrong pronoun, or if you talk about one agency but actually another agency is doing it, they won’t tell you. They’ll just tell you, no that’s not happening. They don’t correct you and say here’s what is happening.

    So you actually have to go from meeting to meeting, to hearing to hearing, asking asking questions — sometimes ridiculous questions — just to get an answer. So this idea that you can just ask, just come into a classified briefing and ask questions and get answers is ridiculous.

    If the government — in an extreme hypothetical, let’s say they had a base on the moon. If I don’t know that there’s a base on the moon, I’m not going to go into the briefing and say you have a moonbase. Right? [Audience laughs.] If they have a talking bear or something, I’m not going to say, ‘You guys, you didn’t engineer the talking bear.’

    You’re not going to ask questions about things you don’t know about. The point of the Intelligence Committee is to provide oversight to Congress and every single member of Congress needs information. Each person in Congress represents about 700,000 people. It’s not acceptable to say, ‘Well, the Intelligence Committees get the information, we don’t need to share with the rest of Congress.’ The Intelligence Committee is not one of the branches of government, but that’s how it’s being treated over and over again.

Easterbrook – The NFL should be called the “Nonprofit Football League”

In The Atlantic, an excerpt from Gregg Easterbrook’s new book The King of Sports: Football’s Impact on America, talks about the fantastic legal and financial advantages enjoyed by the National Football League:

In his office at 345 Park Avenue in Manhattan, NFL Commissioner Roger Goodell must smile when Texas exempts the Cowboys’ stadium from taxes, or the governor of Minnesota bows low to kiss the feet of the NFL. The National Football League is about two things: producing high-quality sports entertainment, which it does very well, and exploiting taxpayers, which it also does very well. Goodell should know — his pay, about $30 million in 2011, flows from an organization that does not pay corporate taxes.

That’s right — extremely profitable and one of the most subsidized organizations in American history, the NFL also enjoys tax-exempt status. On paper, it is the Nonprofit Football League.

This situation came into being in the 1960s, when Congress granted antitrust waivers to what were then the National Football League and the American Football League, allowing them to merge, conduct a common draft, and jointly auction television rights. The merger was good for the sport, stabilizing pro football while ensuring quality of competition. But Congress gave away the store to the NFL while getting almost nothing for the public in return.

The 1961 Sports Broadcasting Act was the first piece of gift-wrapped legislation, granting the leagues legal permission to conduct television-broadcast negotiations in a way that otherwise would have been price collusion. Then, in 1966, Congress enacted Public Law 89‑800, which broadened the limited antitrust exemptions of the 1961 law. Essentially, the 1966 statute said that if the two pro-football leagues of that era merged — they would complete such a merger four years later, forming the current NFL — the new entity could act as a monopoly regarding television rights. Apple or ExxonMobil can only dream of legal permission to function as a monopoly: the 1966 law was effectively a license for NFL owners to print money. Yet this sweetheart deal was offered to the NFL in exchange only for its promise not to schedule games on Friday nights or Saturdays in autumn, when many high schools and colleges play football.

Public Law 89-800 had no name — unlike, say, the catchy USA Patriot Act or the Patient Protection and Affordable Care Act. Congress presumably wanted the bill to be low-profile, given that its effect was to increase NFL owners’ wealth at the expense of average people.

While Public Law 89-800 was being negotiated with congressional leaders, NFL lobbyists tossed in the sort of obscure provision that is the essence of the lobbyist’s art. The phrase or professional football leagues was added to Section 501(c)6 of 26 U.S.C., the Internal Revenue Code. Previously, a sentence in Section 501(c)6 had granted not-for-profit status to “business leagues, chambers of commerce, real-estate boards, or boards of trade.” Since 1966, the code has read: “business leagues, chambers of commerce, real-estate boards, boards of trade, or professional football leagues.”

The insertion of professional football leagues into the definition of not-for-profit organizations was a transparent sellout of public interest. This decision has saved the NFL uncounted millions in tax obligations, which means that ordinary people must pay higher taxes, public spending must decline, or the national debt must increase to make up for the shortfall. Nonprofit status applies to the NFL’s headquarters, which administers the league and its all-important television contracts. Individual teams are for-profit and presumably pay income taxes — though because all except the Green Bay Packers are privately held and do not disclose their finances, it’s impossible to be sure.

Reason.tv: George Will’s Libertarian Evolution

“I’ve lived in Washington now for 44 years, and that’s a lot of folly to witness up close,” says Washington Post columnist George Will. “Whatever confidence and optimism I felt towards the central government when I got here on January 1, 1970 has pretty much dissipated at the hands of the government.”

“In part, I owe my current happiness to Barack Obama,” continues the 72-year-old Will, who “so thoroughly concentrates all of the American progressive tradition and the academic culture that goes with it, that he’s really put the spring in my step.”

Branded “perhaps the most powerful journalist in America” by the Wall Street Journal, Will received the Pulitzer Prize for commentary in 1977 and is the author of numerous books, including Statecraft as Soulcraft: What Government Does, Men at Work: The Craft of Baseball, and One Man’s America: The Pleasures and Provocations of our Singular Nation. A regular panelist on ABC’s This Week, Will has the distinction of having been attacked in the pages of Doonesbury and praised in an episode of Seinfeld (for his “clean, scrubbed look”).

More recently Will has become a champion of libertarianism, both in print and on the air. “America is moving in the libertarians’ direction,” Will wrote in a 2011 review of The Declaration of Independents, “not because they have won an argument but because government and the sectors it dominates have made themselves ludicrous.”

Sometimes it’s better to be lucky

Steve Chapman thinks Barack Obama is a very lucky man indeed:

In assessing the feasibility and probability of Russia’s proposal to secure Bashar al-Assad’s chemical weapons, one overlooked factor should be paramount in our minds: Barack Obama is the luckiest politician on the face of the planet. If he were tied to a railroad track, the train would levitate and pass harmlessly over him. He’s always the windshield, never the bug.

In this instance, Obama got himself into a box that would flummox Harry Houdini. In a procession of careless comments, he said Assad had to go and that if he ever used chemical weapons against rebels, he would face “enormous consequences.”

When the Syrian dictator used them anyway, Obama was forced to prepare for a military strike that found scant public support. When he tried to gain the upper hand by asking for congressional authorization, he got an Arctically frigid reception.

So he faced two unpleasant possibilities: Congress would refuse, in which case he would look like a chump. Or it would agree, forcing him to carry out an attack that was likely to accomplish nothing except to wreck his approval rating.

But then along came the Russians to open an escape route. Acting in response to another unscripted remark, from Secretary of State John Kerry, they proposed to place Syria’s chemical gas arsenal under international control. The Syrians responded by not only admitting that they had such weapons, but offering to surrender them.

The proposal sounded implausible and impractical, but it had too many things going for it to be passed up. Most importantly, it serves the interests of every important party. It spares the Syrian regime a damaging attack by the United States. It spares the rebels being gassed again. It validates the great power status of Russia — and might even win Vladimir Putin a Nobel Peace Prize.

Not least, it saves Obama from looking like an appeaser, a warmonger or an incompetent. It even allows Kerry to portray the administration as unsurpassed in its diplomatic brilliance.

American voters suddenly decide to take a serious look at foreign policy

A guest post at Zero Hedge by Robery W. Merry suggests that somnolent American interest in foreign policy may be waking up:

Political analysts over the next year or so, and historians well into the future, are likely to point to the fall of 2013 as a fundamental inflection point in American politics. That period, they will say, is when the American people forced a major new direction in American foreign policy. Before the events of this fall, the country’s electorate largely delegated foreign policy to its political elite — and largely supported that elite as it projected American military power with more abandon than the country had ever before seen. Even as the government steadfastly expanded the range of international problems that it said required U.S. military action, the electorate accepted that expanded international role and that increasingly promiscuous use of force.

Those days are gone now. The American people conveyed emphatically, in public opinion surveys and in communications to their representatives in Washington, that they did not want their country to launch air strikes against the Bashar al-Assad regime in Syria. Not even if Assad used chemical weapons against his people, as they generally believe he did. Not even if the strikes are limited in magnitude and duration, as Obama promises they will be. Not even if the president of the United States says the strikes are in the country’s national interest. They don’t buy it, and they don’t want it.

Poll numbers in recent days have demonstrated this turnaround in stark fashion. In addition, congressional reluctance to support the president’s authorization request was growing inexorably. The New York Times reported Tuesday that the president was “losing ground in both parties in recent days,” while the Wall Street Journal said support for Mr. Obama’s position on Syria “was slipping in Congress.” If Russia’s Vladimir Putin hadn’t interrupted the U.S. political process with his call for a negotiated end to Assad’s possession of chemical weapons, it seems inevitable that the president would have suffered a devastating political defeat in Congress. That’s still the likely outcome if it ever comes to a vote.

In a survey reported in Tuesday’s New York Times, the paper asked broader questions about American foreign policy, and the results were revealing. Fully 62 percent of respondents said the United States shouldn’t take a leading role in trying to solve foreign conflicts, while only 34 percent said it should. On a question whether the United States should intervene to turn dictatorships into democracies, 72 percent said no. Only 15 percent said yes. The Times said that represents the highest level of opposition recorded by the paper in various polls over the past decade.

To understand the significance of these numbers, along with the political pressures building on lawmakers on the issue, it’s important to note that American political sentiment doesn’t change willy-nilly, for no reason. What we’re seeing is the emergence within the American political consciousness of a sense that the country’s national leaders have led it astray on foreign policy. And, given the country’s foreign-policy history of the past two decades, it isn’t surprising that the people would begin to nudge their leaders with a certain amount of agitation.

The Authorization for the Use of Military Force is “TARP with Tomahawks”

At Reason, Gene Healy explains why the authorization should not be granted to President Obama by congress:

Tonight, President Obama, who rose to the presidency on the strength of stirring speeches, goes back to the well with a prime-time address urging Congress to authorize an attack on Syria.

He admits it’ll be “a heavy lift.” And how: per the Washington Post’s latest whip count in the House, even if all 170 undecideds break their way, the administration won’t be within shouting distance of a majority.

That’s good, because the Authorization for the Use of Military Force that’s on the table deserves to fail. It’s TARP with Tomahawks.

The provisions purporting to restrict the president to a brief, “limited and tailored” war are too weak to stick.

What’s more, they’re undermined by the AUMF’s gratuitous overstatement of presidential power: “The President has authority under the Constitution to use force in order to defend the national security interests of the United States.”

Wrong. The Constitution gives him the power to “repel sudden attacks” against the U.S., not launch them whenever he imagines they’ll promote our “national security interests.” That language practically invites Obama to ignore the limits and wage a wider war.

Update: In another post at Reason the current polling certainly encourages congress not to cave to the President’s wishes.

As the country debates launching airstrikes on Syria, President Barack Obama’s standing on foreign policy has taken such a hit that the latest Reason-Rupe poll finds 64 percent of Americans, including 68 percent of independents and 41 percent of Democrats, believe President Obama’s handling of foreign policy is worse than, or the same as, former President George W. Bush’s handling of foreign policy.

President Obama famously said he opposes “dumb wars.” Nearly three-quarters of Americans, 74 percent, say it would be “unwise” for the United States to launch airstrikes on Syria without the support of the United Nations or Great Britain. Just 17 percent say U.S. strikes on Syria would be wise.

When it comes to launching U.S. military action across the globe, 47 percent of Americans say the “political establishment in Washington D.C.” is more likely to favor military action than they are. A majority of independents, 57 percent, say D.C. insiders are more likely to favor war than they are. In contrast, just 17 percent of Americans say the Beltway establishment is less likely to favor military action than they are, and 30 percent say the establishment favors war about the same amount as the public.

VDH on Obama’s limitations

How did Obama get himself into this mess? It was bound to happen, given his past habits. All we are seeing now is the melodramatic fulfillment of vero possumus, lowering the rising seas, faux Corinthian columns, hope and change, the bows, the Cairo speech, and the audacity of hope. Hubris does earn Nemesis.

1) His inclination is to damn straw men, blame others for his self-inflicted errors, and spike the ball when he should keep quiet and become modest (cf. the bin Laden raid). So in Syria we heard the same old, same old: A host of bad guys, here and abroad, wants to do nothing. Obama alone has the vision and moral compass to restore global and U.S. credibility through his eloquence; but the world disappointed him and is now at fault for establishing red lines that it won’t enforce: He came into the world to save the world, but the world rejected him.

2) Obama thinks in an untrained manner and for all the talk of erudition and education seems bored and distracted — and it shows up in the most critical moments. Had he wished to stop authoritarians, prevent bloodshed and near genocide, and foster true reform in the Middle East, there were plenty of prior, but now blown occasions: a) the “good” war in Afghanistan could have earned his full attention; b) the “bad” Iraq War was won and needed only a residual force to monitor the Maliki government and protect Iraq airspace and ensure quiet; c) the green revolution in Iran was in need of moral support; d) Qaddafi could have been continually pressured for further reform rather than bombed into oblivion; e) postwar Libya needed U.S. leadership to ensure that “lead from behind” did not lead to the present version of Somalia and the disaster in Benghazi; e) long ago, the president could have either kept quiet about Syria or acted on his threats when Assad was tottering and the resistance was less Islamist; f) he could have warned the one vote/one time Muslim Brotherhood early on not to do what everyone in the world knew it would surely do; g) he need not have issued tough serial deadlines to Iran that we have not really enforced and probably have no intention of enforcing.

Instead, Obama relied on his rhetoric and talked loosely, sloppily and inconsistently from crisis to crisis, the only common denominator being that he always took the path of least resistance and thus did nothing concretely to match his cadences. Usually to the degree he made a decision, he made things worse with empty, first-person bombast.

Here’s a poll we’d like to see

Zero Hedge conducts its own poll on this question:

As President Obama continues to push for a plan of limited military intervention in Syria, a new poll of Americans has found that though the nation remains wary over the prospect of becoming involved in another Middle Eastern war, the vast majority of U.S. citizens strongly approve of sending Congress to Syria.

The New York Times/CBS News poll showed that though just 1 in 4 Americans believe that the United States has a responsibility to intervene in the Syrian conflict, more than 90 percent of the public is convinced that putting all 535 representatives of the United States Congress on the ground in Syria — including Senate pro tempore Patrick Leahy, House Speaker John Boehner, House Majority Leader Eric Cantor, and House Minority Leader Nancy Pelosi, and, in fact, all current members of the House and Senate — is the best course of action at this time.

“I believe it is in the best interest of the United States, and the global community as a whole, to move forward with the deployment of all U.S. congressional leaders to Syria immediately,” respondent Carol Abare, 50, said in the nationwide telephone survey, echoing the thoughts of an estimated 9 in 10 Americans who said they “strongly support” any plan of action that involves putting the U.S. House and Senate on the ground in the war-torn Middle Eastern state. “With violence intensifying every day, now is absolutely the right moment — the perfect moment, really — for the United States to send our legislators to the region.”

“In fact, my preference would have been for Congress to be deployed months ago,” she added.

The Electronic Frontier Foundation on reforming the NSA

The EFF has a few suggestions on how to go about reining-in the NSA:

While we still believe that the best first step is a modern Church Committee, an independent, public investigation and accounting of the government’s surveillance programs that affect Americans, members of Congress seem determined to try to enact fixes now. Almost a dozen bills have already been introduced or will be introduced in the coming weeks.

While we’re also waiting to see what the various bills will look like before endorsing anything, here’s — in broad strokes — what we’d like to see, and what should be avoided or opposed as a false response. We know full well that the devil is in the details when it comes to legislation, so these are not set in stone and they aren’t exhaustive. But as the debate continues in Congress, here are some key guideposts.

This first post focuses on surveillance law reform. In later posts we’ll discuss transparency, secret law and the FISA Court as well as other topics raised by the ongoing disclosures. In short, there’s much Congress can and should do here, but we also need to be on the lookout for phony measures dressed as reform that either don’t fix things or take us backwards.

The congressional defenders of privacy

“This is not a game,” Mike Rogers angrily warned last week, urging his colleagues in the House to vote against an amendment that would have banned the mass collection of telephone records by the National Security Agency (NSA). “This is real. It will have real consequences.”

I hope Rogers is right. Despite the Michigan Republican’s best efforts to portray the amendment as a terrifying threat to national security, it failed by a surprisingly narrow margin that could signal the emergence of a bipartisan coalition willing to defend civil liberties against the compromises supported by leaders of both parties.

Rogers was not surprised by the recent revelation that the NSA routinely collects information about every phone call Americans make, just in case it may prove useful in the future. As chairman of the House Intelligence Committee, he knew about the program for years, and he had no problem with it.

Not so two other Michigan congressmen: Justin Amash, a 33-year-old libertarian Republican serving his second term, and John Conyers, an 84-year-old progressive Democrat first elected in 1965. These two legislators, conventionally viewed as occupying opposite ends of the political spectrum, were outraged by the NSA’s data dragnet, especially since representatives of the Bush and Obama administrations had repeatedly denied that any such program existed.

The measure that Amash and Conyers proposed as an amendment to a military spending bill would have required that records demanded under Section 215 of the PATRIOT Act, which authorizes secret court orders seeking “any tangible things” deemed “relevant” to a terrorism investigation, be connected to particular targets. Although it was a pretty mild reform, leaving in place the wide powers granted by Section 215 while repudiating the Obama administration’s even broader, heretofore secret interpretation of that provision, the amendment was viewed as a quixotic effort.
