In Canada, all of &#8220;peoplekind&#8221; were relieved to hear that they won&#8217;t have to give up their American-made binkies quite yet. In return, Trump agreed to pause his 25 percent tariff on goods coming from south of the border. Soon after, he struck a seemingly identical deal with Justin Trudeau, who said he&#8217;d appoint a &#8220;<a href=\"https:\/\/www.yahoo.com\/news\/trump-halts-canadian-tariffs-trudeau-230342730.html\" target=\"_blank\">fentanyl czar<\/a>&#8221; and promised to send 10,000 Canadian troops to the northern border. Who knew they even had that many?! Tariffs will still be levied against Chinese goods starting today, but Trump says he <a href=\"https:\/\/www.reuters.com\/markets\/trump-warns-tariffs-china-may-increase-2025-02-03\/\" target=\"_blank\">plans to talk<\/a> with President Xi Jinping as soon as this week.<\/p><\/blockquote>\n<p>The <em>FP<\/em> isn&#8217;t wrong &#8230; the Canadian Army doesn&#8217;t <em>have<\/em> 10,000 spare troops just hanging around their barracks who could be sent to the border, so it&#8217;s much more likely to be a combination of Canadian Border Services Agency (CBSA) agents, RCMP officers, provincial police (if the respective provinces are willing), and whatever the army can spare. (Trudeau refers only to &#8220;nearly 10,000 frontline personnel&#8221;, not &#8220;troops&#8221; as a lot of US reports state &#8230; that seems a lot more achievable.)<\/p>\n<p>You may be wondering how the US President has such disruptive and antagonistic tools at his disposal. Why is every new American president now a Napoleon, and why isn&#8217;t this at all a political issue in the U.S.?<\/p>\n<p>The American Constitution, it seems, has no political party apart from a handful of cranky, tireless libertarians like <a href=\"https:\/\/en.wikipedia.org\/wiki\/Gene_Healy\" target=\"_blank\">Gene Healy<\/a>, <a href=\"https:\/\/cei.org\/studies\/ten-thousand-commandments-2024\/\" target=\"_blank\">Clyde W. Crews<\/a> or Ilya Somin, who has a new article spitballing possible litigation approaches for Americans who lie in the path of the tariffs now being <a href=\"https:\/\/reason.com\/volokh\/2025\/02\/02\/challenge-trumps-tariffs-under-the-nondelegation-and-major-questions-doctrines\/\" target=\"_blank\">wishcasted into existence by Napoleon the 47th<\/a>. Somin explains that President Donald Trump is using an openly contrived &#8220;national emergency&#8221; to invoke powers delegated to the White House by Congress in 1977, powers that are to be invoked only in the face of &#8220;unusual and extraordinary threats&#8221; to the Republic.<\/p>\n<p>Since the president apparently has plenary power to define an emergency, and to do so without offering anything resembling a rational explanation, this act of Congress now appears to be less of a delegation and more of a surrender \u2014 a total abandonment of constitutional principle and the classical separation of powers.
