{"id":9323,"date":"2011-05-14T00:38:40","date_gmt":"2011-05-14T04:38:40","guid":{"rendered":"http:\/\/quotulatiousness.ca\/blog\/?p=9323"},"modified":"2011-05-13T17:03:30","modified_gmt":"2011-05-13T21:03:30","slug":"for-their-next-act-theyll-allow-quartering-large-bodies-of-armed-troops","status":"publish","type":"post","link":"https:\/\/quotulatiousness.ca\/blog\/2011\/05\/14\/for-their-next-act-theyll-allow-quartering-large-bodies-of-armed-troops\/","title":{"rendered":"For their next act, they&#8217;ll allow &#8220;quartering large bodies of armed troops&#8221;"},"content":{"rendered":"<p>Indiana must be an interesting place to live, but their Supreme Court has an <a href=\"http:\/\/www.nwitimes.com\/news\/local\/govt-and-politics\/article_ec169697-a19e-525f-a532-81b3df229697.html?mode=story\" target=\"_blank\">odd view<\/a> of the notion that a man&#8217;s home is his castle:<\/p>\n<blockquote>\n<p>Overturning a common law dating back to the English Magna Carta of 1215, the Indiana Supreme Court ruled Thursday that Hoosiers have no right to resist unlawful police entry into their homes.<\/p>\n<p>In a 3-2 decision, Justice Steven David writing for the court said if a police officer wants to enter a home for any reason or no reason at all, a homeowner cannot do anything to block the officer&#8217;s entry.<\/p>\n<p>&#8220;We believe &#8230; a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence,&#8221; David said. &#8220;We also find that allowing resistance unnecessarily escalates the level of violence and therefore the risk of injuries to all parties involved without preventing the arrest.&#8221;<\/p>\n<\/blockquote>\n<p>And as I&#8217;m sure the law&#8217;n&#8217;order folks will be quick to point out, if you&#8217;ve done nothing wrong you&#8217;ve got nothing to worry about, right?<\/p>\n<p>Even better, this is the <em>second time this week<\/em> that the court has reduced the rights of Indiana residents against police intrusion:<\/p>\n<blockquote>\n<p>This is the second major Indiana Supreme Court ruling this week involving police entry into a home.<\/p>\n<p>On Tuesday, the court said police serving a warrant may enter a home without knocking if officers decide circumstances justify it.
