Provincial Court Judge David Patterson said in a decision <a href=\"https:\/\/www.canlii.org\/en\/bc\/bcpc\/doc\/2024\/2024bcpc29\/2024bcpc29.html?resultIndex=2&#038;resultId=8f50cc88636247d5a2d3889e80c87d1c&#038;searchId=2024-03-12T09:09:15:729\/62393a2d92b84d0ab658521b5ecc4ca0&#038;searchUrlHash=AAAAAQAHbGVnYXVsdAAAAAAB\" rel=\"noopener\" target=\"_blank\">published this week<\/a>.<\/p>\n<p>Patterson warned his fellow judges &#8220;to be alive to the issue of Indigenous identity fraud&#8221; and begin demanding &#8220;proof&#8221; that offenders are &#8220;entitled to be sentenced as an Indigenous person&#8221;.<\/p>\n<p>The decision was in regards to a Prince George, B.C., pastor, Nathan Legault, who was convicted of several charges related to the sexual victimization of young girls under his supervision, including a conviction for the making of child pornography.<\/p>\n<p>But before the sentencing, Legault told the court he now self-identified as M\u00e9tis, and should thus be subject to Gladue Rights \u2014 a system wherein judges are required to consider lighter and &#8220;alternate&#8221; sentences for Indigenous offenders.<\/p>\n<p>First written into the Criminal Code in 1995 and then <a href=\"https:\/\/scc-csc.lexum.com\/scc-csc\/scc-csc\/en\/item\/1695\/index.do\" rel=\"noopener\" target=\"_blank\">encoded in the 1999 Supreme Court decision<\/a> <em>R v. Gladue<\/em>, these principles were explicitly introduced to reduce rates of Indigenous incarceration by requiring judges to consider &#8220;the circumstances of Aboriginal offenders&#8221; before applying a legal sanction.<\/p>\n<p><em>R v. Gladue<\/em> states specifically that the principle is &#8220;not to be taken as a means of automatically reducing the prison sentence of aboriginal offenders&#8221;.
