{"id":20753,"date":"2013-06-20T11:07:49","date_gmt":"2013-06-20T16:07:49","guid":{"rendered":"http:\/\/quotulatiousness.ca\/blog\/?p=20753"},"modified":"2025-06-29T11:44:51","modified_gmt":"2025-06-29T15:44:51","slug":"supreme-court-refuses-to-hear-appeal-of-rob-fords-conflict-of-interest-case","status":"publish","type":"post","link":"https:\/\/quotulatiousness.ca\/blog\/2013\/06\/20\/supreme-court-refuses-to-hear-appeal-of-rob-fords-conflict-of-interest-case\/","title":{"rendered":"Supreme Court refuses to hear appeal of Rob Ford&#8217;s conflict-of-interest case"},"content":{"rendered":"<p>The <em>Toronto Star<\/em> must be feeling <a href=\"http:\/\/www.680news.com\/2013\/06\/20\/supreme-court-says-it-won-t-hear-appeal-against-mayor-ford\/\" target=\"_blank\"><strong>devastated<\/strong><\/a> by this:<\/p>\n<blockquote><p>The Supreme Court of Canada says it will not hear an appeal in a conflict-of-interest case against Toronto Mayor Rob Ford.<\/p>\n<p>The court dismissed it with costs, but did not give reasons for the ruling.<\/p>\n<p>Lawyer Clayton Ruby was trying to restore a lower court decision from November 2012, in which Superior Court Justice Charles Hackland ruled Ford be removed from office.<\/p>\n<p>However, as part of Ford\u2019s appeal, the decision was overturned by an Ontario Divisional Court panel in January 2013.<\/p>\n<p>Deputy mayor Doug Holyday said this was all about antagonizing the mayor.<\/p>\n<p>\u201cThere was no reason to take this to the Supreme Court; there was very little likelihood of it every getting put before the Supreme Court,\u201d Holyday said.<\/p><\/blockquote>\n<p><b>Update<\/b>: The CBC reports that <a href=\"http:\/\/www.cbc.ca\/news\/politics\/story\/2013\/06\/19\/toronto-mayor-rob-ford-supreme-court-appeal-conflict-decision-notice.html\" target=\"_blank\">Ford feels vindicated<\/a> by the decision:<\/p>\n<blockquote><p>Toronto Mayor Rob Ford expressed relief Thursday that a conflict challenge that previously threatened to oust him from office won\u2019t be revived in the country\u2019s top court.<\/p>\n<p>&#8220;I&#8217;m so happy this is finally over. I\u2019ve been vindicated and we can move on,\u201d Ford told reporters in Toronto, about two hours after the Supreme Court of Canada rejected an application to hear a final appeal in the much-publicized conflict case that began last year.<\/p>\n<p>As is customary, the Supreme Court gave no reasons for dismissing the appeal, but legal experts \u2014 including the lawyer who filed the application himself \u2014 had acknowledged the odds of reviving the conflict of interest case were a long shot.<\/p>\n<p>The court only accepted 12 per cent of appeal requests made last year.<\/p>\n<p>Toronto resident Paul Magder filed an application in an Ontario court last year, alleging that Ford had violated conflict of interest legislation when he participated in a council vote that absolved his need to pay back funds donated to his private football foundation.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The Toronto Star must be feeling devastated by this: The Supreme Court of Canada says it will not hear an appeal in a conflict-of-interest case against Toronto Mayor Rob Ford.
