You can say “Space” and you can say “Marines”, but you can’t say “Space Marines”

Apparently Games Workshop owns the trademarked term “Space Marines”, so nobody else is supposed to use it:

For years, there have been stories about Games Workshop being trademark bullies and sending threats to people who use the term “space marine” in connection with games. But now that they’ve started publishing ebooks, Games Workshop has begun to assert a trademark on the generic, widely used, very old term “space marine” in connection with science fiction literature.

A few important notes:

* Amazon didn’t have to honor the takedown notice. Takedown notices are a copyright thing, a creature of the Digital Millennium Copyright Act. They don’t apply to trademark claims. This is Amazon taking voluntary steps that are in no way required in law.

* Games Workshop’s strategy is to make “space marine” less generic by launching high profile, bullying attacks on everyone who uses it, so that there will come a day when people hearing the phrase immediately conclude that it must be related to Games Workshop, because everyone know what colossal dicks they are whenever anyone else uses the phrase

* Trademarks only apply to commercial works. You can and should use “space marine” in your everyday speech, fanfic, tweets and so on. For one thing, it will undermine Games Workshop’s attempts to homestead our common language.

Update: John Scalzi clearly feels the claim lacks merit:

I am not a lawyer, so factor that in here. That said: Games Workshop, really? You know, a simple search on the term “space marines” over at Google Books shows a crapload of prior art for “space marines” in science fiction literature, from the 1936 Amazing Tales novelette “The Space Marines and the Slavers” by Bob Olsen, to Robert Heinlein’s novel Space Cadet, to the very recent use of the term in The Sheriff of Yrnameer by Michael Reubens and So You Created a Wormhole: The Time Traveler’s Guide to Time Travel by Phil Hornshaw and Nick Hurwitch. There is no lack of evidence that the phrase “space marines” has been used rather promiscuously in science fiction literature up to this point.

To argue, as Games Workshop must, that the phrase “space marines” has a distinctive character in science fiction literature relating only to their product involves, shall we say, a certain studied ignorance of the field. Table top games? Possibly; I’m not an expert. Science fiction literature? You have got to be kidding. It’s pretty damn generic in this field, and was long before 1987, when Warhammer 40,000 was created in game form . Nor does it seem, as far as I know, that Games Workshop attempted to claim trademark on the phrase “space marine” before, despite a veritable plethora of Warhammer 40K tie-in literature using the phrase.

Having (in)famous ancestors

John Scalzi is having mixed reactions to all the Twitter updates about Lincoln and theatres:

And he wrote about his infamous relative a few years ago:

Every family should have an interesting skeleton in the family closet. In my family, it’s John Wilkes Booth, assassin of Abraham Lincoln, who, of course, was the President of the United States during the American Civil War. Booth assassinated Lincoln not long after the cessation of hostilities between the Union and the Confederacy, by sneaking into the President’s box at Ford’s Theater (the show: Our American Cousin) and shooting him in the back of the head with a pistol. Booth then leaped from the box to the stage, shouting “Sic semper tyrannis” (“Thus it is with tyrants”) and “The South is avenged.” He broke his leg but managed to escape nevertheless. However, eleven days later, he was discovered in a barn, burned out, and then shot (by himself or by a soldier, it’s unclear). He died shortly thereafter. Some maintain that Booth’s body was never positively identified, so it’s possible he actually escaped. Either way, he’s dead now.

For the record, I’m not a direct descendant — my line goes through one of his nine other siblings, making him something along the lines of a great-great-great-great-great-grand-uncle. Whenever I mention my relationship to him, though, people’s eyes get wide, their jaws go momentarily slack, and some people actually back up a step, as if a long dormant assassination gene might suddenly fire up, and they’d be the unlucky recipient. I get a kick out of that. Then I go for the extra point my mentioning that John Wilkes and I have the same birthday: May 10, 131 years apart. By the time I mention I get edgy handling pennies and five dollar bills, people begin to wend their way to the nearest door.

Repost: A tribute (of sorts) to Wiarton Willie

John Scalzi, several years ago, wrote a tribute to Wiarton Willie, who was in the news in an unaccustomed way at the time:

To tell you the truth, the most disturbing thing is not that the groundhog died — certainly this animal earned his eternal rest — but that his handlers couldn’t think of anything better to do but tell a festival crowd that he had croaked. Those kids in the crowd will be forever traumatized. Groundhog Day will no longer be a happy time, but a constant reminder of death and mortality in the bleak midwinter. 10 years from now, I expect that Wiarton, Canada will become the new North American epicenter of dark, gothic teenage poetry.

Lying frozen in the snow
The groundhog soul resides far below
Gone to a place of doom and gray
Now winter will always stay.
Die Groundhog Die!
Mommy and Daddy Lied!

But wait, there’s more:

Now, on to the groundhog Wiarton Willie, who, as you know from yesterday’s entry, died before Groundhog Day and whose body was photographed lying in state in a dinky little pine coffin. Or was it? Now news comes from the sordid little burg of Wiarton, Canada, that the rodent corpse in the coffin was not Wiarton Willie at all, but a stuffed stand-in. The real Willie was apparently found so decomposed that the gelatinous remains were unsuitable for public display. So the town elders found a stuffed groundhog that just happened to be lying around (apparently the body of a previous “Wiarton Willie,” who was no doubt poisoned by the current, and now rotting, Willie in an unseemly palace coup), plopped it into that Barbie coffin, and presented the remains to a horrified public. Here’s the groundhog you’ve all been waiting for! And he’s dead! Winter for the next ten years!

The people of Wiarton meant well, I’m sure. But I’m having serious doubts as to their combined mental capacity. First off, the real Willy was found in a state of advanced decomposition, which means he had been dead for weeks. Weeks. How could that happen? This rodent is the cornerstone of Wiarton’s entire tourism economy for the month of February, and no one bothers to check on him from time to time? Did they just stick him in a cage after last Groundhog Day and then forget to feed him? Every kid in the world had a hamster they forgot to feed, but you’re usually, like, five at the time. These were actual adults. They say he was hibernating when he died. Sure he was. I used that excuse about the hamster.

Megan McArdle: There is no “quick fix” for poor communities

If the “nudge” notion of government worked, it’d be pretty creepy:

If poor people did the stuff that middle class people do, it’s possible — maybe probable — that they wouldn’t be poor. But this is much harder than it sounds. As John Scalzi once memorably put it, “Being poor is having to live with choices you didn’t know you made when you were 14 years old.” Which often means, he might have added, spending your whole life doing the sort of jobs that middle class people sometimes do when they’re 14. It isn’t that people can’t get out of this: they do it quite frequently. But in order to do so, you need the will and the skill — and the luck — to execute perfectly. There is no margin for error in the lives of the working poor.

And some problems are collective problems. It’s all very well to say that poor women shouldn’t have kids unless they can find a solid man to help raise them. (And I agree that this is a superior strategy). But men with solid jobs are rather scarce in many poor communities, not least because we’ve imprisoned so many of them. What you’re asking poor women to do is actually, for most of them, to not have babies. This is an easy edict to deliver from a comfortable middle class home where you have all the kids you want. It probably sounds pretty shitty, however, to the poor women who you are blithely commanding to spend their lives alone.

What I am struggling to say is that however much those choices are now inflected by what went before — and the problems of other people in their families and communities — they are choices. We understand that the middle class girl I grew up with is driving her situation by behavior that is probably not very amenable to outside influence. Why do we assume that people who grew up poor are somehow more pliable simply because similar choices are influenced by decades of generational poverty?

As adults they are the products of everything that has happened to them, and everything that they have done, but they are also now exercising free will. If you assume you know the choice they should make, and that there is some reliable way to entice them to make it, you’re imagining away their humanity, and replacing it with an automaton.

Having higher wage jobs available would give people more money which would be a good thing, and it would solve the sort of problems that stem from a simple lack of money. But it would not turn them into different people.

Public policy can modestly improve the incentives and choice sets that poor people face — and it should do those things. But it cannot remake people into something more to the liking of bourgeois taxpayers. And it would actually be pretty creepy if it could.

Chutzpah, or the new Cook’s Source plagiarism service now open

Did you know that the internet is not public domain? The editors at Cook’s Source apparently thought it was, because they printed an article without the permission of the original author, and then told her that she should be happy they didn’t bill her for editing it. (It’s an article on medieval cooking, with original spelling preserved from the source texts: of course it would look weird to a modern eye.)

The exchanges between the original author and the editor make for amusing reading:

After the first couple of emails, the editor of Cooks Source asked me what I wanted — I responded that I wanted an apology on Facebook, a printed apology in the magazine and $130 donation (which turns out to be about $0.10 per word of the original article) to be given to the Columbia School of Journalism.

What I got instead was this (I am just quoting a piece of it here:)

“Yes Monica, I have been doing this for 3 decades, having been an editor at The Voice, Housitonic Home and Connecticut Woman Magazine. I do know about copyright laws. It was “my bad” indeed, and, as the magazine is put together in long sessions, tired eyes and minds somethings forget to do these things.

But honestly Monica, the web is considered “public domain” and you should be happy we just didn’t “lift” your whole article and put someone else’s name on it! It happens a lot, clearly more than you are aware of, especially on college campuses, and the workplace. If you took offence and are unhappy, I am sorry, but you as a professional should know that the article we used written by you was in very bad need of editing, and is much better now than was originally. Now it will work well for your portfolio. For that reason, I have a bit of a difficult time with your requests for monetary gain, albeit for such a fine (and very wealthy!) institution. We put some time into rewrites, you should compensate me! I never charge young writers for advice or rewriting poorly written pieces, and have many who write for me… ALWAYS for free!”

The Guild breaks into comics

Didn’t it used to be the other way around, with comics graduating to live action shows or movies? Well, in this case, Felicia Day’s brilliant web series The Guild is moving to comic form, at least for three issues:

It’s too bad she has to work on her new Syfy movie today. Otherwise, Felicia Day would totally be stopping by any and all Toronto comic shops.

An actress, writer and much-loved geek goddess, Day has successfully transplanted her popular Web series The Guild from the Internet to the page as scribe for Dark Horse Comics’ charming new The Guild, a three-issue miniseries debuting in stores today.

She’s reminded of the one random day in Barnes & Noble when she first saw a DVD of The Guild, the award-winning online comedy that for three seasons has followed a girl named Cyd (Day) and her guild of eccentric fellow online gamers known as the Knights of Good.

“I kind of geeked out and took a picture of it for my own posterity. But I’m such a book and comic lover. It’s just seeing something that has my name on it. And then my face twice on one of the covers! So that’s kind of like, ‘Ugh, get over yourself,’ ” Day says, laughing.

“I can’t help but get a little sick of my face, but it is exciting. It’s fun to see myself drawn.”

I’m sure hoping that the no-longer-accurately-titled “World’s Biggest Book Store” has a copy in stock when I visit there tonight.

Update, 25 March: No, they didn’t. They also didn’t have John Scalzi’s The God Engines or The Trade of Queens, the final book in the Merchant Princes series by Charles Stross. I did manage to get one of the four items I was looking for, The New Vichy Syndrome: Why European Intellectuals Surrender to Barbarism by Theodore Dalrymple.

Top SF/Fantasy works

Tyler Cowen linked to Alex Carnevale’s top 100 SF&F works, which has some odd choices (Jack Vance and Ursula K. LeGuin appear to have been the compiler’s favourite authors). In the comments to Tyler’s post, an alternate (unannotated) list by David Pringle was recommended. Pringle’s list doesn’t include Fantasy books, so there’s less overlap between the two than you might expect.

No list of this kind is, or can be, truly authoritative, but there are some common items on each list I can’t criticize as being in the top of the field:

  • The Moon is a Harsh Mistress, Robert Heinlein. Carnevale has this at #2. Pringle doesn’t list it, but has several other (in my opinion, lesser) Heinlein works on his list. This is one of the best libertarian SF novels ever. Even if you’re not over-fond of his work, this short novel is well worth reading.
  • Frankenstein Mary Shelley. This book made #6 for Carnevale, but didn’t make Pringle’s list. I read this when I was 12, and it made quite an impression on me, although I have to admit I like it much more now than I did on first reading it.
  • Dune, Frank Herbert. Carnevale likes it much more than Pringle (#11 versus #48). I liked the original book, but lost interest sometime later in the series.
  • The Hobbit and The Lord of the Rings, J.R.R. Tolkien. Not the original fantasy work, but probably the most common source for inspiration (and verging-on-outright-plagiarism) for an entire sub-field of Fantasy.
  • Stranger in a Strange Land, Robert Heinlein. One of the most subversive books ever published, at least as far as the middle class of the 1960’s was concerned. On the surface, it’s the story of a Martian named Smith. It seems to be one of those books you either love or hate — not much middle ground here.
  • Alice in Wonderland, Lewis Carroll. Pair this with Carroll’s Through the Looking-Glass for the full effect. Another author whose work has been strip-mined for ideas by later writers.
  • 1984 by George Orwell. Pringle’s #1 pick and Carnevale’s #26. I’d certainly put it in my top ten.
  • Fahrenheit 451, Ray Bradbury. This book made both lists (#8 for Pringle,#27 for Carnevale), but I’m afraid I’ve never read it (I tried a couple of Bradbury books when I was in my early teens, but never warmed to him as an author).
  • The Man in the High Castle, Philip K. Dick. Another book that made both lists, but which I haven’t read, and for similar reasons. Early experiences with an author’s work can have long-lasting effects.
  • A Fire upon the Deep by Vernor Vinge. A book that appeals to both fans of the huge stage of deep space and aficionados of the early Internet.
  • Citizen of the Galaxy, Robert Heinlein. One of the very best “young adult” SF novels from before they called them that. Both a coming of age novel and a condemnation of slavery and hypocrisy. Powerful stuff for young minds.
  • Starship Troopers, Robert Heinlein. Another great polarizer: it’s either the best military SF novel ever written or the worst piece of hyper-Fascist propaganda ever written. It’s interesting that Heinlein wrote this book at about the same time as he was working on Stranger. Readers who only knew about the one work might have suffered severe mental whiplash to find he’d written the other one, too. Either way, pretend that the film never happened (aside from the names, it doesn’t have much to do with the novel).
  • The Hitchhiker’s Guide to the Galaxy, Douglas Adams. You want whimsical? HHG took whimsy to a whole different level. What Terry Pratchett did with Fantasy, Adams did with SF.
  • Animal Farm, George Orwell. A book that suffers from being pushed on high school students as mandatory reading. The revolution on the farm, and the aftermath.
  • The Baroque Cycle, Neal Stephenson. A huge four-volume work that repays the effort to work through. Some authors work best at a certain length (short story, novella, novel, etc.). Stephenson seems to work best at the library-shelf level.
  • Ringworld, Larry Niven. I wouldn’t call this a top-ten, but the series of books in this series certainly belong in the top 100.
  • A Canticle for Leibowitz, Walter M. Miller. Post-apocalyptic done well.
  • Snow Crash, Neal Stephenson. Certainly one of the most entertaining books I’ve ever read (it helped that I was working in the computer industry at the time). From Stephenson’s earlier less-than-library-shelf-length period.
  • The Day of the Triffids, John Wyndham. A book I had to read in middle school, yet one I still recall with great affection. Few books can survive being forced down kids’ throats. This one can.
  • Memory, Mirror Dance, and A Civil Campaign, Lois McMaster Bujold. I had trouble stopping at just three of Bujold’s “Vorkosigan” series, as they’re all highly entertaining and deeply engaging. Some call it space opera, but it’s far more involved and well-executed than that easy label would indicate. One of the very best SF authors ever. Her more recent work is predominantly Fantasy, and while they’re very good, I’m more interested in her SF writing.
  • The Atrocity Archive and The Jennifer Morgue, Charles Stross. Imagine if the British secret service had an even more eldritch secret service component. But run strictly according to civil service rules.
  • Pyramids, Men at Arms, Interesting Times, and The Wee Free Men, Terry Pratchett. Another author for whom it is difficult to select even a few examples (they’re all so good). His Discworld series started as a simple pastiche of typical swords-and-sorcery novels, but which quickly outgrew the confines of the first few books. The Wee Free Men is the first of a series of Young Adult novels for the Discworld (including A Hat Full of Sky, Wintersmith and the forthcoming I Shall Wear Midnight).
  • Old Man’s War, John Scalzi. Another military SF story, but so well thought-out and executed as to transcend the ordinary levels of the sub-genre. Follow-on works are equally good (The Ghost Brigades, The Last Colony, and Zoe’s Tale).
  • Island in the Sea of Time, S.M. Stirling. Another time-travel story, but avoiding the usual pitfalls of time travel story lines (the secret was to go back before written history…). This was the first book of a trilogy. Stirling is currently completing a related series of stories hinging on what happened to the world left behind in the original trilogy (starting with Dies the Fire).
  • The Probability Broach, L. Neil Smith. More interesting (and amusing) ideas per page than any other novel of its era. Another libertarian book, but don’t let the label scare you off: great reading.

What’s that? No Clarke? No Asimov? No Sturgeon? No Card? No Zelazny? No Brunner? Not in the top whatever-number-I-stopped-at. Each has strong fans, and some good work, but not top-rank in my view.

Nostalgia’s over-rated

John Scalzi looks at a few things folks tend to get all misty-eyed and nostalgic about. Here’s why he thinks you’re on crack:

1. Stupidly expensive long-distance charges. [. . .] When my sister briefly lived with me when I was in Fresno, between the two of us we could generate $600 phone bills on a monthly basis, at a time when I was paying $400 a month for an apartment. Yes! I was occasionally paying more for my phone bill than I was for having a place to eat and sleep. Naturally, this was madness.

2. Crappy old cars. Which cars qualify as crappy old cars? In my opinion, pretty much all of them. Pre-catalytic converter cars were shoddily-constructed, lead-spewing deathtraps, the first generation of cars running on unleaded were even more shoddily-constructed 70s defeat-mobiles, the 80s were the golden age of Detroit Doesn’t Give a Shit, and so on. You have to get to about 1997 before there’s a car I would willingly get into these days. As opposed to today, when even the cheap boxy cars meant for first-time buyers have decent mileage, will protect you if you’re hit by a semi, and have more gizmos and better living conditions than my first couple of apartments.

3. Physical media for music. Audiophiles like to wank on about the warmth of vinyl, and you know, maybe if you take your vinyl and put it into special static free sleeves and then store those sleeves in a purpose-built room filled with inert gases, to be retrieved only when you play that vinyl on your $10,000 turntable which could play a record without skipping through a 7.5 earthquake, ported through your vacuum tube amplifier that sucks down more energy than Philadelphia at night, maybe it is warm. Good for you and your warm vinyl.

4. Smoking allowed everywhere. You know what? It did suck to have smokers at the table next to you at a restaurant. It did suck to have a movie theater haze up. It did suck to be walking in the mall and have some wildly gesticulating smoker randomly and accidentally jam the lit end of his cancer stick into your face.

A partial answer about increasing body weight

Here are some useful images that help to explain why North Americans have been getting heavier over the last few decades:

Over the past few decades, portion sizes of everything from muffins to sandwiches have grown considerably. Unfortunately, America’s waistbands have reacted accordingly. In the 1970s, around 47 percent of Americans were overweight or obese; now 66 percent of us are. In addition, the number of just obese people has doubled, from 15 percent of our population to 30 percent.

While increased sizes haven’t been the sole contributor to our obesity epidemic, large quantities of cheap food have distorted our perceptions of what a typical meal is supposed to look like. These portion comparisons, adapted from the National Heart, Lung, and Blood Institute’s (NHLBI) Portion Distortion Quiz, give a visual representation of what sizes used to be compared to what they are today.

Awful book covers

Seriously, now, DAW, wtf? I know there’s a recession on, but there must be a better class of 12-year-old you can hire to push about the “liquefy” tool in Photoshop. I get that you were aiming for “chintzy, kooky fun” but you landed on “Fourth grade class project on Lulu.com,” and that just isn’t cool, and more to the point, you should know the difference. Were I an author in this particular anthology I would be sad I couldn’t show my friends the book I was in without them asking how much it cost me to publish it. I’m frightened to show it to graphic designers I know because I don’t want to be sued for damages when it causes blood to shoot from their ears. And as a reader, I can say the cover makes a really excellent argument for owning a Kindle.

How to sell a film to a major studio

John Scalzi provides some helpful hints to the producers of Creation, who are complaining that they can’t get a US distributor to pick up the movie (because of all the Christian fundamentalists, y’see):

. . . leaving aside any discussion of the actual quality of the film, it may be that a quiet story about the difficult relationship between an increasingly agnostic 19th Century British scientist and his increasingly devout wife, thrown into sharp relief by the death of their beloved 10-year-old daughter, performed by mid-list stars, is not exactly the sort of film that’s going to draw in a huge winter holiday crowd, regardless of whether that scientist happens to be Darwin or not, and that these facts are rather more pertinent, from a potential distributor’s point of view.

The major US studios are no longer really tuned to distribute films like this in any event. Maybe if Charles Darwin were played by Will Smith, was a gun-toting robot sent back from the future to learn how to love, and to kill the crap out of the alien baby eaters cleverly disguised as Galapagos tortoises, and then some way were contrived for Jennifer Connelly to expose her breasts to RoboDarwin two-thirds of the way through the film, and there were explosions and lasers and stunt men flying 150 feet into the air, then we might be talking wide-release from a modern major studio. Otherwise, you know, not so much. The “oh, it’s too controversial for Americans” comment is, I suspect, a bit of face-saving rationalization from a producer flummoxed that such an obvious bit of Oscar-trollery such as this film has been to date widely ignored by the people he assumed would fall over themselves to have such a thing.
